Abstract
Статтю присвячено визначенню поняття колізій у законодавстві та їх класифікації. Доведено, що наявність колізій у системі законодавства призводить до негативних наслідків для правової системи держави та судової практики. Виявлено причини виникнення колізій у законодавстві. Автором проведено аналіз наукових підходів та судової практики до розуміння поняття та видів колізій у законодавстві. Охарактеризовано особливості виникнення ієрархічних, змістовних та темпоральних колізій у законодавстві; визначено ознаки кожного з видів колізій. islation The article is devoted to the definition of the concept of conflicts in legislation and their classification. It is proven that the presence of legal conflicts in the legislation system leads to negative consequences for the legal system of the state and domestic judicial practice. The causes of conflicts in the legislation and legal positions of the Supreme Court have been revealed.
The author conducted an analysis of scientific approaches and judicial practice to understand the concept and types of conflicts in legislation. The peculiarities of the emergence of hierarchical, substantive and temporal conflicts in legislation are characterized; signs of each type of collision are defined.
