| dc.description.abstract | У статті розглянуто проблему забезпечення незалежності судової влади загалом і незалежності суддів як носіїв цієї влади. Підтверджено, що орієнтирами для Української держави слугують стандарти статусу суддів, що містяться в актах Ради Європи й інших європейських інституцій. Відзначено, що єдиний перелік європейських стандартів щодо статусу суддів відсутній, не розроблені чіткі критерії їх диференціації на обов’язкові та рекомендаційні. Визначено акти, які закріплюють європейські вимоги щодо статусу суддів. Наголошено, що провідним принципом статусу суддів є принцип незалежності. Висвітлено еволюцію вітчизняного законодавства про судоустрій і статус суддів. Установлено, що Концепція судово-правової реформи в Україні задекларувала принцип незалежності судової влади. The article deals with the problem of judicial independence in general and independence of judges as bearers of that power. It is confirmed that the reference points for the Ukrainian state are the standards of the status of judges contained in the acts of the Council of Europe and other European institutions. It is noted that there is no unified list of European standards of the status of judges; no clear criteria for their differentiation into mandatory and recommendatory standards have been developed. Acts setting European requirements for the status of judges were defined. It is emphasized that the leading principle of the status of judges is the principle of independence. The process of development of domestic legislation on the judicial system and the status of judges is considered. It is established that the Concept of judicial and legal reform in Ukraine declared the principle of independence of the judiciary. | |
