Abstract
У статті досліджено проблемні питання, пов’язані з виконанням Україною своїх міжнародно-правових зобов’язань, передбачених Конвенцією Ради Європи про підроблення медичної продукції та подібні злочини, що загрожують охороні здоров’я. Акцентовано увагу на значенні основних термінів і понять, які вживаються у Конвенції, та проаналізовано узгодженість між їх міжнародно-правовим розумінням і вітчизняним тлумаченням. Доведено, що завдання з імплементації положень Конвенції у національне законодавство вирішено лише частково, тому надалі необхідним є коригування чинних законодавчих норм шляхом внесення до них змін і доповнень. The article deals with the issues of Ukraine’s compliance with its international legal obligations under the Council of Europe Convention on counterfeiting of medical products and similar offenses that threaten health protection. The emphasis is placed on the meaning of the basic terms and concepts used in the Convention, and the consistency between their international legal understanding and the domestic interpretation is analyzed. It is proved that the task of implementing the provisions of the Convention in the national legislation was resolved only in part, therefore in the future it is necessary to adjust the current legislative norms by introducing amendments and additions.
