Abstract
Вивчається етимологічне походження та сучасне лексичне значення слова «кримінальний». Формулюється визначення поняття «кримінальне право», в основу якого закладається нормативістська концепція праворозуміння. Досліджуються ознаки поняття «закон» і «кримінальний закон». Визначається співвідношення кримінального права та кримінального закону. Ставиться дискусійне питання щодо коректності використання терміна «кримінальний закон». Обґрунтовується висновок, що кримінальне право та кримінальний закон співвідносяться як зміст і форма існування (вираження) цього змісту. Etymological origins and modern lexical meaning of the word “criminal” are studied. The definition of the concept of “criminal law” is formulated on the basis of the normative concept of legal understanding. Features of concepts “law” and “criminal law” are studied. The correlation of criminal law and Criminal Code is determined. The discussion on the correctness of using of the definition “criminal law” is raised. It is substantiated that criminal law and Criminal Code are correlated as the content and the form of existence (expression) of this content.
