| dc.description.abstract | У статті досліджено основні складові частини предмета видавничого договору, встановлено їх характерні ознаки. Аналізуючи основні елементи пред- мета видавничих договорів, автор особливу увагу звертає на особливості прав та обов’язків сторін видавничого договору, визначає предмет і об’єкт видав- ничого договору. Визначено зміст майнових прав автора, повноваження, які можуть передавитися за договором. Наголошено, що чинне законодавство закріплює за автором виключні права на використання створеного ним твору. Це означає, що автор не тільки вирішує питання про оприлюднення твору, але й визначає, з якого моменту, в яких формах та обсягах буде відкрито доступ до твору для невизначеного кола осіб. The main components of the subject of the publishing contract are investigated in the article, the characteristic features of its constituent parts are established. Analyzing the main elements of the subject of publishing contracts, the author pays special attention to the peculiarities of the rights and obligations of the parties to the publishing contract, defines the subject and object of the publishing contract. The content of the author’s property rights, the powers that can be transferred under the contract are determined. It is emphasized that the current legislation establishes the author’s exclusive rights to use the work created by him. This means that the author not only solves the issue of the publication of the work, but also determines from what point in what forms and volumes the work will be open to an indefinite circle of persons. | |
