| dc.description.abstract | У статті досліджені проблеми здійснення основних напрямів реалізації принципів функціонування органів публічної адміністрації. Запропоновано сучасне тлумачення поняття організації функціонування органів публічної адміністрації. Встановлено, що перелік принципів організації функціонування органів публічної адміністрації, які, будучи вихідними положеннями їх створення та функціонування, включає як закріплені в нормативно-правових актах, так і визначені теоретично засади. Наголошено, що значною вадою правового регулювання означеного питання в законодавстві України, встановленою шляхом порівняння принципів організації функціонування органів публічної адміністрації, закріплених в законах України стосовно діяльності органів публічної адміністрації, є відсутність єдиного переліку принципів, які були б притаманні організації функціонування органів публічної адміністрації всіх без винятку органів публічної адміністрації, і відповідно закріплені в загальному нормативно-правовому акті з питань організації функціонування органів публічної адміністрації в Україні або спеціальних нормативно-правових актах. The article investigates the problems of implementation of the main directions of implementation of the principles of functioning of public administration bodies. The modern interpretation of the concept of organization of functioning of public administration is proposed that the list of principles of organization of functioning of public administration bodies, which, being the initial provisions of their creation and functioning, includes both enshrined in the normative legal acts, and theoretically defined principles. It is emphasized that a significant defending of the legal regulation of the specified issue in the legislation of Ukraine, established by comparing the principles of organization of functioning of public administration bodies, enshrined in the laws of Ukraine regarding the activity of public administration bodies, is the lack of a single list of principles that would be inherent in the organization of functioning of public administration. | |
