| dc.description.abstract | Стаття присвячена проблематиці правової природи, регулювання та реалізації безперервності судового розгляду кримінального провадження. Використовуючи напрацювання, викладені у доктрині кримінального процесу, ґрунтуючись на аналізі кримінального процесуального регулювання, авторка дійшла висновку, що безперервність судового розгляду полягає у вимозі безупинного його проведення або у спосіб (без невиправданих перерв і відкладень), щоб період між судовими засіданнями визначався такими часовими інтервалами, які забезпечували б суду можливість з’ясування обставин кримінального провадження та дослідження доказів, не відволікаючись на інші судові процеси. The article is devoted to the problems of the legal nature, regulation and implementation of continuity of trial in criminal proceedings. Using the findings set forth in the doctrine of criminal procedure, based on the analysis of criminal procedural regulation, the author came to the conclusion that the continuity of the trial consists in the requirement for its continuous conduct or in such a way (without unjustified interruptions and postponements) that the period between court sessions is determined by such time intervals, which would provide the court with the opportunity to find out the circumstances of the criminal proceedings and examine the evidence, without being distracted by other court processes. | |
