Abstract
У статті порушується питання доцільності розгляду подорожей, фінансування витрат на які здійснюється не за власний кошт публічного службовця або державного чи місцевого бюджетів, а коштом «альтернативних джерел» як різновиду подарунку, на які мають поширюватися обмеження, передбачені антикорупційним законодавством. Специфіка статусу публічного службовця та його професійної діяльності, пов’язаної із реалізацією публічно-владних повноважень, зумовлює потребу унормування відносин, пов’язаних із подорожами публічних службовців у зв’язку з їх професійною діяльністю, у разі їх фінансування з «альтернативного джерела». Аналіз чинного вітчизняного законодавства свідчить про наявність прогалини у врегулюванні відносин щодо подорожей публічних службовців на загальнодержавному рівні, що зумовлює різноваріативність практики правозастосування. The article raises the question of the expediency of considering travel, the financing of which is not carried out at the expense of a public servant or the state or local budgets, and at the expense of "alternative sources" as a kind of gift, which should be subject to the restrictions provided for by anti-corruption legislation. The specifics of the status of a public servant and his professional activities related to the exercise of public authority give rise to the need to normalize the relations related to the travel of public servants related to their professional activities, if they are financed from an "alternative source". An analysis of current domestic legislation shows that there is a gap in the regulation of the relations of travel of public servants at the national level, which determines the heterogeneity of the practice of law enforcement. The author substantiates the need to standardize the principles of regulating the relations in order to eliminate the preconditions for a conflict of interest in the public service as a whole.
