| dc.description.abstract | Стаття присвячена дослідженню співвідношення інституту державної гарантії як засобу забезпечення виконання зобов’язань суб’єктів господарювання (резидентів України) та інституту державно-приватного партнерства в Україні, а також визначенню місця державної гарантії в механізмі реалізації державно-приватного партнерства. Окремо досліджується можливість правового забезпечення використання державної гарантії в рамках реалізації проектів державно-приватного партнерства. У статті наведено коротку історичну довідку щодо державно-приватного партнерства як правового інституту в Україні. Окремо аналізуються і порівнюються ознаки інституту державно-приватного партнерства й інституту державної гарантії в Україні на сучасному етапі. The article is devoted to the study of the interrelation of the state guarantee institute as a mean of ensuring the fulfillment of obligations of economic entities (residents of Ukraine) and the institute of public private partnership in Ukraine, as well as determining the place of the state guarantee in the mechanism of public private partnership implementation. The possibility of legal support of use of the state guarantee in the framework of implementation of public private partnership projects is explored separately. The article contains a brief historical digression concerning the public private partnership as a legal institute in Ukraine. The features of the institute of public private partnership and the institute of state guarantee in Ukraine are separately analyzed and compared at the present stage. | |
