| dc.description.abstract | Метою статті є аналіз специфіки самозахисту прав особи в умовах digital-суспільства. У статті проаналізовано проблемні аспекти захисту прав від порушень у мережі Інтернет. Виявлено, що деякі форми захисту (зокрема, судовий) майже обмежені для використання через складність визначення порушника прав в інформаційному середовищі або ж через порушення прав осіб інформаційними транснаціональними корпораціями (Google, Facebook тощо), правосуб’єктність яких в охоронних правовідносинах в Україні є під питанням через відсутність їхнього офіційного представника в нашій державі. Зроблено висновок про підвищення ролі самозахисту як форми захисту суб’єктивних цивільних прав в інформаційних відносинах в Україні. The purpose of the article is to analyze the specifics of self-defense of human rights in a digital society. The article analyzes the problematic aspects of protecting rights from violations on the Internet. It is revealed that some forms of protection (in particular, judicial) are practically limited to use due to the complexity of determining the violator of rights in the information environment, or due to violations of the rights of individuals by information multinational corporations (Google, Facebook, etc.), whose legal personality in protective legal relations in Ukraine is questionable due to the absence of their official representative in our state. It is concluded that the role of self-defense as a form of protection of subjective civil rights in information relations in Ukraine is increasing. | |
