Abstract
Розглянуто проблему формування показань неповнолітнього потерпілого у кримінальному провадженні України в умовах сьогодення. З’ясовано зміст синергетичного походження під час вирішення глобального завдання захисту прав дітей, які стали жертвами кримінальних правопорушень. Встановлено чинники, що сприяють розв’язанню актуальних перешкод під час налагодження контакту з дитиною. Акцентовано увагу на професійному підході фахівців, які можуть впливати на актуалізацію забутого в пам’яті дитини. Визначено високе аксіологічне значення комплексного підходу для вирішення проблеми ефективного допиту неповнолітніх потерпілих, в першу чергу, в умовах військового протистояння та під час розповсюдження по всьому світові епідемій. Проаналізовано чинні законодавчі ініціативи, що спрямовані на зміну підходів та динаміку впровадження нових успішних методик захисту прав дітей направлену, в тому числі, на збереження їх прав під час допиту. Досліджено окремі аспекти захисту дітей в Україні від насильства під час запровадження моделі Барнахус, що має активне розповсюдження в окремих містах України як «будинку дітей» та пілотного проєкту «Вихователь безпеки». This article is concerning on problem of forming the minor victim’s testimony in the criminal proceedings in Ukraine in modern conditions. The meaning of synergetic origin in solving the global task of protection of rights of children who became victims of criminal offences has been clarified. Factors contributing to overcome obstacles during establishing contact with the child have been established. Attention has been focused on the professional approach of specialists who can influence upon the actualization of the forgotten in the child’s memory. The high axiological value of a complex approach to solving the problem of effective interrogation of minor victims first of all during the armed conflict and during the spread of epidemics around the world has been determined. Current legislative initiatives aimed at changing the approaches and implementation of new successful methods of children’s rights protection aimed at preserving their rights during interrogation have been analyzed. Some aspects of the protection of children from violence in Ukraine during the introduction of the Barnahus model, which is actively spreading in some cities of Ukraine as a “children’s house”, have been studied.
