| dc.description.abstract | Стаття присвячена дослідженню змагальності як специфічного правового феномену американської моделі цивільного судочинства. Приводяться теоретичні погляди американської процесуальної науки щодо поняття та сутності та завдання цивільної процесуальної змагальності. Розглядається історичний шлях становлення змагальності в американському цивільному судочинстві та характеризується його сучасний стан. Проаналізовані правові основи змагальності та досліджено особливість прояву змагальності в процесі обміну змагальними документами між сторонами,судового розгляду справи та доказування при здійснені цивільного судочинства у США. Пропонується авторське визначення змагальності у американській моделі цивільного судочинства. This article is devoted to the disclosure of the essence of the phenomenon of competitiveness in the American model of civil justice. Adversary is considered as a principle of civil proceedings, which provides an opportunity for effective consideration of a civil dispute, in which equal participants in a legal process “clash” their interests in order to bring their cases to justice, which, being essentially neutral, is obliged to follow the procedural order consideration of the case and check its material basis for compliance with the law. As an example of the appearance of adversarial proceedings in the American form of civil proceedings, the following are indicated: the pleading procedure , the evidentiary process, and judicial debates. Based on the study, a general definition of the concept and essence of adversarial proceedings in civil proceedings in the United States is proposed. | |
