Abstract
У 2015 р. були внесені зміни до чинного КЗпП України, якими була заборонена дискримінація за ознаками сексуальної орієнтації та гендерної ідентичності. Але зміни до законодавства – це не зміни у свідомості більшості членів суспільства та норм суспільної моралі, що й зумовлює непоодинокі випадки порушення права на недискримінацію людей через сексуальну орієнтацію та гендерну ідентифікацію. Вказане дає можливість констатувати, що в українському суспільстві зберігається високий рівень упередженості до представників ЛГБТ-спільноти, що проявляється в численних випадках дискримінації, порушення права на повагу до людської гідності, свободи слова та мирних зібрань, а також у вчиненні злочинів на ґрунті гомофобної та трансфобної нетерпимості. In 2015 certain changes were introduced into the Labour Code of Ukraine which prohibited the discrimination based on sexual orientation and gender identity. However, changes of legislation do not mean changes of the mentality of the majority of the members of society, which is often the reason of numerous cases of violation of the right not to be discriminated against due to sexual orientation or gender identity. The abovementioned allows us to claim that Ukrainian society still retains a high level of bias against the members of the LGBT community which can be seen in a wide range of discrimination cases violating human dignity, freedom of speech and peaceful assembly rights along with cases of crimes committed on the basis of homophobic and transphobic intolerance.
