Abstract
У статті визначено характерні ознаки змісту правового поняття «творча праця» в науці трудового права, проаналізовано нормативно-правові акти, що регулюють трудові відносин у сфері творчої праці. Автором з’ясовано, що у спеціальній юридичній літературі зміст поняття «творча праця» («творча діяльність») досліджувався за методологією трудового права недостатньою мірою. Як правило, вчені трудового права вивчали зміст творчої праці лише професійних творчих працівників відповідно до Закону України «Про професійних творчих працівників та творчі спілки». Творча ж праця некваліфікованих і кваліфікованих працівників, у яких основні трудові обов’язки не завжди пов’язані з реалізацією творчих здібностей, залишалась поза їхньою увагою. The article defines the essential features of the content of the legal concept “creative work” in the science of labor law, analyzes the normative legal acts regulating labor relations in the field of creative work. The author found out that in the special legal literature the content of the concept of “creative work” (“creative activity”) was insufficiently studied according to the methodology of labor law. As a rule, scientists of labor law studied the content of creative work of professional creative workers in accordance with the Law of Ukraine “On professional creative workers and creative unions”. The creative work of unskilled and skilled workers, in which the main work responsibilities are not always associated with the implementation of creative abilities, remained out of their attention.
