Abstract
У статті на підставі аналізу наукових позицій учених, а також законодавства України узагальнено підходи до тлумачення поняття організаційно-правових засад дізнання як форми спрощеного досудового розслідування кримінальних правопорушень, прокурорського нагляду, судового контролю та взаємодії з громадськістю. Охарактеризовано загальноправові підстави функціонування підрозділів дізнання у співпраці з органами судової влади, прокуратури України та громадськістю. Доведено, що сутність цієї взаємодії, хоч і виражається в багатьох формах, має на меті забезпечити виконання завдань кримінального провадження та охорону прав і свобод людини й громадянина. Based on the analysis of scientific positions of scientists, as well as the legislation of Ukraine, the article summarizes approaches to the interpretation of the concept of organizational and legal principles, inquiry as a form of simplified pre-trial investigation of criminal offenses, prosecutorial supervision, judicial control and public relations. The general legal grounds for the functioning of inquiry units in cooperation with the judiciary, the Prosecutor’s Office of Ukraine and the public are described, it is proved that the essence of this interaction, although expressed in many forms.
