Item Пандемія CОVID-19 та домашнє і гендерно зумовлене насильство. Covid-19 Pandemic and Domestic and Gender-Forced Violence(2022) Прус, І. М.; Prus, I.Актуальність. Наукова стаття висвітлює стан і перспективи розв‟язання проблем, пов‟язаних із домашнім, гендерно зумовленим насильством під час пандемії CОVID-19. Виокремлено здобутки, проблеми, а також напрями вдосконалення системи заходів, спрямованих на протидію зазначеним негативним явищам, з огляду на іноземний досвід. Метою статті є здійснення аналізу взаємовпливу та співвідношення пандемії CОVID-19, домашнього й гендерно зумовленого насильства, порівняльно-правове дослідження окресленої проблематики та пошуку шляхів її розв‟язання в країнах – членах ЄС, США, Китаю та в Україні. Одним з ключових завдань слід вважати підготовку відповідних пропозицій, спрямованих на ефективне попередження, розкриття фактів вчинення таких протиправних діянь і притягнення винних до відповідальності, а також попередження поширення таких негативних явищ у майбутньому. Topicality. The scientific article highlights the state and prospects of solving the problems related to domestic, gender-based violence during the COVID-19 pandemic. The author singles out the achievements, problems, as well as areas for improving the system of measures aimed at counteracting these negative phenomena, taking into account foreign experience. The aim of the article is to analyze the interaction and relationship between the COVID-19 pandemic, domestic and gender-based violence, comparative legal research on this issue and find ways to solve it in EU member states, USA, China and Ukraine. One of the key tasks should be the preparation of appropriate proposals aimed at effective prevention, disclosure of the facts of such illegal acts and bringing the perpetrators to justice, as well as preventing the spread of such negative phenomena in the future.Item Особливості протидії домашньому насильству в Україні: філософсько-методологічний аспект. А.; Horbach-Kudria, I.Актуальність статті зумовлена потребою забезпечення комплексного інтегрованого підходу до подолання насильства в Україні та сприяння реалізації прав осіб, постраждалих від домашнього насильства, шляхом запобігання насильству, ефективного реагування на факти насильства, надання допомоги й захисту постраждалим особам, забезпечення відшкодування заподіяної шкоди, належного розслідування фактів насильства та притягнення кривдників до передбаченої законом відповідальності. З огляду на актуальність обраної теми, метою пропонованої роботи є дослідження особливостей реалізації державної політики у сфері запобігання та протидії домашньому насильству уповноваженими суб‟єктами, у межах компетенції яких передбачено застосування спеціальних заходів щодо протидії домашньому насильству. Topicality of the article is dictated by the need to ensure a comprehensive integrated approach to overcoming violence in Ukraine and protecting the rightsvictims of domestic violence by preventing violence, effective response to violence, assistance and protection to victims, compensation for damages, proper investigation of violence and bringing perpetrators to justice. У зв‟язку із введенням в Україні воєнного стану тимчасово можуть бути обмеженими деякі конституційні права та свободи людини й громадянина. У цих умовах і задля забезпечення ефективної діяльності військово-цивільних адміністрацій, сформованих на території України, можливе тимчасове обмеження права на освіту, що є одним із фундаментальних прав людини й громадянина, яке захищене та гарантоване державою. Topicality. Due to the imposition of martial law in Ukraine, some constitutional rights and freedoms of man and citizen may be temporarily restricted. In these conditions and in order to ensure the effective operation of military-civil administrations formed on the territory of Ukraine, it is possible to temporarily restrict the right to education, which is one of the fundamental human and civil rights protected and guaranteed by the state. The purpose of the article is to study the state of regulatory and legal support of the constitutional right of citizens to education and the organization of the educational process under the legal regime of martial law. This goal necessitated the implementation of a number of research tasks, including, in particular, the analysis of regulatory and legal regulation of the educational process in martial law; development of a number of legislative propo-sals to ensure access to educational services for students in modern conditions.
