Item ВІДРОДЖЕННЯ СЛОВ’ЯНСЬКОЇ ПРАВОВОЇ КУЛЬТУРИ В УКРАЇНІ(2015) РЯЗАНОВ М.Ю.Статтю присвячено розгляду процесу рецепції зарубіжного досвіду як процесу копіювання іноземних нормативно-правових актів без урахування національних особливостей розвитку правової культури України. Обґрунтовується теза, що утилітарний характер запозичення західного права призвів до втрати в народу впевненості в справедливості права, що впливає на загальний стан правопорядку в суспільстві. Як рятівний шлях розглядається необхідність відродження слов’янської правової культури як культурної цілісності. Обґрунтовуються духовно-моральні, релігійні основи слов’янської правової культури, які являють собою духовно-регулятивну спільність: права, правди, православ’я. The article considers the process of reception of international experience as a process of copying foreign legal acts, excluding the national peculiarities of legal culture in Ukraine. The thesis that the utilitarian nature of borrowing Western law has led to a loss of confidence in the people of the justice of law, which affects the general state of law and order in society. How saving way addresses the need for the revival of the Slavic Legal culture as cultural integrity. Settle spiritual, moral and religious foundations of Slavonic legal culture, which are spiritual and regulatory community: law, truth, orthodoxy.Item ЗАКОНОДАВЧА РЕГЛАМЕНТАЦІЯ МІСЦЕВОГО САМОВРЯДУВАННЯ УКРАЇНСЬКИХ МІСТ(2015) ІДЕСІС І.І.У статті обґрунтовано тезу про те, що Конституція України та чинні закони не приділяють належної уваги особливостям здійснення місцевого самоврядування в містах; мають місце лише поодинокі фрагментарні норми із цього приводу. У статті виявлено особливості місцевого самоврядування в містах на підставі аналізу Конституції України, законів України «Про місцеве самоврядування в Україні», «Про місцеві вибори», «Про статус депутатів місцевих рад», «Про добровільне об’єднання територіальних громад». Сформульовано напрями для подальших розробок поставленого питання. In the article the author arguments the thesis that the Constitution as the fundamental law and current legislation in Ukraine does not pay enough attention to the peculiarities of local government in the cities; there are only a few fragmentary rules in this regard. The article analyzes different approaches to the definition of a treaty; summarizes its characteristics and differences from other sources of law; classifies legal agreements; compares specific types of treaties in national and European law.Item ПЕРВАЯ КОНСТИТУЦИЯ НЕЗАВИСИМОГО АЗЕРБАЙДЖАНА КАК ЗАСЛУГА ОБЩЕНАЦИОНАЛЬНОГО ЛИДЕРА ГЕЙДАРА АЛИЕВА(2015) ГУЛИЕВ А.Д.Після відновлення державної незалежності одним із життєво важливих завдань, що стояли перед азербайджанським народом, було здійснення заходів для визначення основних напрямів майбутнього розвитку Азербайджану. Необхідний був новий закон, який відобразив би концептуальні основи й фундаментальні принципи майбутнього розвитку країни. Однак відсутність на той час у країні політичної стабільності й політичної волі, які відображали б інтереси народу, унеможливлювала реалізацію поставлених завдань. Тільки після повернення великого лідера Гейдара Алієва до керівництва країною було сформовано необхідне суспільно-політичне середовище, що дозволило почати широкомасштабні реформи у всіх сферах життя держави й суспільства, у тому числі прийняти Основний Закон. Конституція 1995 року є першою Конституцією незалежного Азербайджану, у її прийнятті неоціненна заслуга Гейдара Алієва. After the restoration of state independence one of the essential tasks facing the Azerbaijani people was the implementation of necessary measures to determine the main directions of the future development of Azerbaijan. We needed a new law reflecting the conceptual bases and fundamental principles of the future development of the country. However the absence at that time in the country a political stability and political will that reflects the people’s interests made it impossible to achieve the set up objectives. It was only after the return of great leader Heydar Aliyev to the leadership of the country the necessary social and political environment was formed that has allowed to begin large-scale reforms in all areas of life of the state and society, including the adoption of the Fundamental Law. The Constitution of 1995 is the first Constitution of independent Azerbaijan and in its adoption there is an invaluable merit of Heydar Aliyev.Item Право і суспільство №6-2(2015)Item ПРАВОВІ ТА ОРГАНІЗАЦІЙНІ ФОРМИ РЕАЛІЗАЦІЇ ПРАВОЗАХИСНОЇ ФУНКЦІЇ СУЧАСНОЇ ДЕРЖАВИ(2015) БОНДАРЕНКО А.І.У статті здійснено дослідження форм реалізації правозахисної функції сучасної держави як однорідної, правової й організаційної діяльності уповноважених державних органів, наділених належною компетенцією. Систематизовано погляди науковців на розуміння форм реалізації функцій держави та їх класифікацію. Детально досліджено правові й організаційні форми реалізації функцій держави. Здійснено спробу застосувати «класичний» поділ форм реалізації функцій держави на правові та неправові (організаційні) до форм реалізації правозахисної функції держави, у результаті чого запропоновано авторську класифікацію форм реалізації правозахисної функції сучасної держави. The article presents the study of the forms of realization of the human rights functions of the modern state as a homogeneous, the legal and organizational activities of the authorized state bodies with proper jurisdiction. There were systematized views of scientists to understand the forms of implementing the functions of the state, and their classification. More studied the legal and organizational form of implementation of the functions of the state. Attempt was made to apply the “classical” forms of realization of the separation of state functions in the legal and non-legal (organizational) forms of realization of the implementation of the human rights functions of the state, which resulted in the author’s proposed classification of the forms of realization of the human rights functions of a modern state.Item РЕАЛІЗАЦІЯ ОКРЕМИХ ПОЛОЖЕНЬ ДЕКЛАРАЦІЇ ПРО ДЕРЖАВНИЙ СУВЕРЕНІТЕТ УКРАЇНИ(2015) ОМАРОВА А.А.У статті досліджується питання становлення й розвитку законодавства щодо державного управління та місцевого самоврядування в Українській РСР у період 1990–1991 рр. Розглянуто й проаналізовано важливі нормативно-правові акти, які стали законодавчою базою для вдосконалення органів влади Української РСР. The article studies the question of the formation and development of the legislation on state administration and local self-government in the Ukrainian SSR in the period 1990–1991. Important regulations, which became the legislative framework for improving the government of the Ukrainian SSR, were considered and analyzed.Item УМОВИ ЕФЕКТИВНОСТІ МЕХАНІЗМУ ПРАВОВОГО РЕГУЛЮВАННЯ(2015) КУРАКІН О.М.Автор статті висуває гіпотезу про те, що загальні умови як зовнішні прояви середовища не виявляють себе тільки як «фон» механізму правового регулювання. Вони виступають фактором, що спонукає до зміни змісту його елементів. Однак під час їх встановлення нераціонально підходити до них як до рівноцінних факторів. Необхідно враховувати, що всі вони перебувають між собою в тісному взаємозв’язку й тільки їх поєднання може забезпечити ефективність механізму правового регулювання. The author hypothesizes that common conditions like symptoms environment not manifest themselves only as the «background» legal regulation mechanism. They advocate a factor prompting a change in the content of its elements. However, when installed, irrational approach them as equivalent factors.
