    ЗГОДА У КРИМІНАЛЬНИХ ПРАВОПОРУШЕННЯХ ПРОТИ СТАТЕВОЇ СВОБОДИ ТА СТАТЕВОЇ НЕДОТОРКАНОСТІ ОСОБИ. CONSENT IN CRIMINAL OFFENCES AGAINST SEXUAL FREEDOM AND SEXUAL INVIOLABILITY OF A PERSON

    Досліджено значення та зміст згоди у кримінальних правопорушеннях проти статевої свободи та статевої недоторканності особи, які передбачені Розділом IV Кримінального Кодексу (КК) України. У статті встановлено, що відсутність згоди є конструктивною ознакою зґвалтування, сексуального насильства та примушування до вступу в статевий зв’язок. Визначено шляхи вирішення проблем, що виникають у кваліфікації ситуацій, в яких особа помилково вважає, що згода була надана, а також, коли згода не була надана явно. Рекомендовано уточнити зміст «добровільної згоди» вказавши у примітці до ст. 152 КК, які дії не можуть вказувати на добровільність згоди. Встановлено, що згода є розмежувальною ознакою складу кримінального правопорушення, передбаченого ст.ст. 152, 153 та 155 КК. Combating sexual violence still remains one of the most important issues arisen in criminal law study. It should be noted that Istanbul Convention on preventing and combating violence against women and domestic violence is still not ratified by Ukraine, which shall facilitate quality of criminal law concerning criminal offences against sexual freedom and sexual inviolability of a person. The paper provides that consent shall be both constructive and distinguishing feature of criminal offences against sexual freedom and sexual inviolability. Several problems of consent in such crimes are defined as well as ways of their solution.

    У статті констатується поступове відродження туристичної діяльності. Визначено, що система управління туристичною галуззю в умовах децентралізації в Україні є невпорядкованою, побудованою на лобістських засадах, складається з різних за кількістю та якістю посадових осіб, має недостатнє фінансування та нецільове використання виділених коштів. Доведено важливість створення в умовах децентралізації такого механізму управління, який буде ефективним навіть за умови мінімального фінансування туристичної галузі, різної кількості працівників у даній сфері та забезпечуватиме високий рівень їх професіоналізму. Запропоновано створення туристичних відділів на регіональному та місцевому рівнях; здійснення підготовки та підвищення кваліфікації фахівців-управлінців, якими у зв’язку із займаною посадою будуть виконуватись покладені повноваження у сфері туризму. The paper states the gradual revival of tourism, both in Ukraine and in the world. That is why we believe that tourism, especially in the western and southern regions of our country can become a significant driver of economic development of local communities. For the rapid and successful development of the tourism industry in Ukraine, it is necessary to find internal reserves to increase demand for domestic tourism products, increase ways to meet consumer demands for content, diversity and quality of tourism and recreation services. It is determined that the system of management of the tourism industry in the context of decentralization in Ukraine is disorganized, built on lobbying principles, consists of different in number and quality of officials, has insufficient funding and misuse of allocated funds. The importance of creating a decentralized management mechanism in the conditions of decentralization, which will be effective even with minimal funding of the tourism industry, different number of employees in this field and will ensure a high level of their professionalism. It is proposed to create tourist departments at the regional and local levels; training and retraining of specialists-managers, who in connection with the position will perform the assigned powers in the field of tourism. A separate area is the improvement or change of the law on tourism adopted in 1995, which does not fully meet modern realities and requires comprehensive changes that would meet the interests and modern needs of society. We believe that it is very important that tourism should be planned on a comprehensive basis, taking into account all aspects of legislation relating to other sectors that have a direct or indirect impact on it.

    Стаття присвячена аналізу юридичної конструкції спеціальної конфіскації. Із цією метою виокремлено основні елементи юридичної конструкції зазначеного заходу кримінально-правового характеру та проаналізовано їх як окремо, так і у системному взаємозв’язку. Виокремлено неточні елементи юридичної конструкції спеціальної конфіскації, а також колізійні положення ст.ст. 961 та 962 Кримінального Кодексу України. Проаналізовано проблемність вживання словосполучення «добросовісний набувач» у тексті норм, що регулюють спеціальну конфіскацію. Виконано релевантні висновки. This paper highlights the main elements of the legal construction of special forfeiture at the present stage of its legal regulation. Ambiguous elements of the construction of special forfeiture that require legislative adjustment have been identified. Clearly conflicting provisions of the norms of the law of Ukraine on criminal liability concerning the legal construction of special forfeiture are singled out. Relevant conclusions are made.

    Розкрито сутність та особливий характер доказів в справах про адміністративні проступки. Доведена особливість застосування окремих видів доказів органами Державної прикордонної служби України в адміністративному провадженні. Сучасний стан розвитку законодавчого забезпечення адміністративного провадження, яке здійснюється органами та посадовими особами Державної прикордонної служби України (далі – ДПСУ) охоплює майже всі без виключення аспекти, ефективності реалізації мети адміністративної відповідальності – невідтворного притягнення до неї винної особи. Розкрито особливості організаційно-правового регулювання окремих видів доказів та способів доказування. Зроблено висновки про підвищення ефективності доказування та використання доказів Державною прикордонною службою України в адміністративному проваджені. The current state of legislative support of administrative proceedings, which is carried out by bodies and officials of the State Border Guard Service of Ukraine (hereinafter – SBGSU) covers almost all aspects without exception, the effectiveness of implementation of the goal of administrative responsibility – irreproducible bringing the guilty person to it. However, there are also certain objective shortcomings associated with the peculiarities of implementation by the SBGSU of its powers in the field of state border protection, as well as the evolution of social relations and technological development, the rate of which is much higher than the development of legislative support. It is about the organizational and legal support of the process of use of evidence and implementation of the very process of proving in cases of administrative proceedings of the State Tax Service of Ukraine. It is noted that more extensive use will be made of electronic means of obtaining information in the case, fixing offenses, databases with information on the legal basis for a person's stay in Ukraine, as well as electronic evidence and means of proof. This is due to the high level of responsibility of the State Tax Service of Ukraine as a body protecting the state border of Ukraine. At the same time, when completing the protocol on an administrative offence, it is necessary to fully and comprehensively determine what means of evidence have been obtained, what kind of evidence and what it proves. Also, such type of evidence as personal explanations and testimonies of officials of the State Tax Service of Ukraine are widely used, especially if the detention of a person takes place outside of control points and checkpoints. Therefore, such testimonies and evidence require detailing in the protocol on administrative proceedings with an indication of the potential or availability of evidence in support of the facts stated. Accordingly, organizational and legal provision of evidence in the considered type of administrative cases requires systematization, which can be achieved by including norms and provisions that regulate relevant aspects in the activities of the State Border Service of Ukraine in the Instruction on registration by officials of the State Border Service of Ukraine of materials on administrative offences, approved by the Order of the MIA of Ukraine from 18/09/2013 № 898. There were disclosed the essence and special nature of evidence in cases of administrative misconduct. It was investigated the peculiarity of the use of certain types of evidence by the bodies of the State Border Guard Service of Ukraine in administrative proceedings. There were determined the peculiarities of organizational and legal regulation of certain types of evidence and methods of proof. It was made a conclusion on increasing the efficiency of proving and using evidence by the State Border Guard Service of Ukraine in administrative proceedings.

    ПРОБЛЕМНІ ПИТАННЯ ЗАМІНИ АБО ВІДМОВИ ВІД АДВОКАТА-ЗАХИСНИКА, ЯКИЙ НАДАЄ БЕЗОПЛАТНУ ВТОРИННУ ПРАВОВУ ДОПОМОГУ У КРИМІНАЛЬНОМУ ПРОЦЕСІ. PROBLEMATIC ISSUES OF REPLACEMENT OR WAIVER OF THE RIGHT TO ACCEPT A DEFENSE LAWYER'S SERVICES WHO PROVIDES FREE SECONDARY LEGAL AID IN CRIMINAL PROCEEDINGS

    У статті проаналізовано неоднорідне застосування чинного законодавства у практичній діяльності судами, автором пропонується внесення змін до процесуальних норм, якими регулюються дані відносини, зокрема, розгляд питання відмови (заміни) від адвоката в межах окремого процесу, обґрунтовується необхідність такого розгляду і прийняття рішення слідчим суддею. Пропоновані зміни, на погляд автора, визначають єдність підходу у вирішенні даних питань, пов’язаних зі зміною чи відмовою підозрюваного (обвинуваченого) від захисника, зберігаючи підзахисному право на вільний вибір адвоката й захищаючи його від розголошення обраної лінії захисту стороні обвинувачення. The paper raises the issue of waiver (replacement) of a state defense lawyer by a suspect (accused) who provides free legal aid in criminal proceedings. The author analyzes the provisions of the current legislation in Ukraine, which regulates the provision (replacement) of a lawyer, compares and analyzes the practice of courts in the application of the law, focuses on the issue of determining the criteria for the quality of services provided by a lawyer, studies the view on this problem through the decisions of the ECHR (European Court of Human Rights), and also suggests ways to solve this problem by amending the current legislation and presents a fundamentally new approach to the procedure of waiver (replacement) of a lawyer in criminal proceedings. In the paper, the author notes the problem in the legislative definition of the possibility of waiver (replacement) of the lawyer and, as a result, the uneven application of the law occurs in practice by the courts; it is proposed to amend the specific procedural rules that regulate these relations, namely, to detach the issue of waiver (replacement) of the lawyer into a separate process, the author justifies the need for such detachment and decision-making by the investigating judge. The author notes that the issue of refusal (replacement) of a lawyer during a pre-trial investigation with a legally defined adversarial proceeding is decided by the prosecution-the investigator (prosecutor), which is in itself wrong and can affect the choice of a lawyer, his tactics and methods of defense. The proposed changes, in the author's opinion, solve the problem of inconsistency in the application of the law in terms of waiver (replacement) of a defense lawyer by a suspect (accused), determine the unity of approach in solving these issues, preserving the defendant's right to choose freely a lawyer and protecting him from disclosing the chosen line of defense to the prosecution.

    Функціонування платіжних систем в умовах сьогодення можуть генерувати ряд фінансових ризиків: кредитний, ліквідності, валютний, операційний, правовий, системний. Тому в результаті проведеного дослідження було визначено сутність поняття «платіжна система». Проведено характеристику основних ризиків, що генеруються платіжними системами. Розглянуто основні положення щодо управління та оцінки таких ризиків. Визначено основні концептуальні засади здійснення нагляду (оверсайту) за платіжними системами в України. Структуровано основні етапи оцінювання впливу фінансових ризиків, які генеруються використанням платіжних систем на основі результатів діяльності банків України. Проведено аналіз впливу ризиків, які генеруються використанням платіжних систем, на результативні показники діяльності банків. Payment system is a complex system of managing funds transfers and settlements between economic entities, which ensures the rational implementation of the basic functions, uninterrupted financing of activities using the latest methods and payment instruments used to reduce cash flow and ensure the effectiveness of monetary, monetary policy countries. In the course of its functioning, the payment system, like any economic system, can be exposed to the risks of its professional activity. Characteristic risks of the payment system are credit risk, liquidity risk, currency risk, operational, legal and systemic. In the event of risks, an effective management system should be implemented, taking into account all possible scenarios of impact, both micro- and macroeconomic factors, which could cause significant losses at all levels of government. An important aspect of a payment system's risk management policy is that it is adequately assessed. The main stages of assessing the level of financial risks generated by the use of payment systems and their impact on the performance indicators are: 1. Systematization and formalization of financial risk factors generated by the use of payment systems. 2. Constructing a multiple multivariate regression equation, realizing the relation between factor (X) and performance (B). 3. The choice of factor traits to include them in the equation of the economic-mathematical model of standardized regression. 4. Economic interpretation of the results of correlation-regression analysis and their use in the decision-making process. Information base for assessing the level of risks generated by the use of payment systems is the NBU's official data on the activity of Ukrainian banks. It should be noted that the most sensitive to the risks generated by the use of payment systems are: liquidity risk; credit risk, currency risk. Thus, in a context of uncertainty and environmental volatility for banking institutions, the strategic aspect should be to focus on securing competitive positions, determining the acceptable level of risk through the use of the latest economic and mathematical modeling tools, extrapolation forecasting, fuzzy set theory, and choice of payment systems with them should be a strategic priority for each organization.
