    МЕТОДОЛОГІЧНИЙ ІНСТРУМЕНТАРІЙ СУДОВО-ЕКСПЕРТНОЇ ДІЯЛЬНОСТІ. METHODOLOGICAL TOOLKIT OF FORENSIC EXPERT ACTIVITIES

    У статті досліджено методологічний інструментарій судово-експертної діяльності. Зазначено, що забезпечення результативності експертного забезпечення правосуддя обумовлює необхідність пошуку релевантних методологічних підходів, які об’єднують діалектично пов’язані між собою методи. Стисло охарактеризовано методологічні підходи (системний, пракселогічний, хронологічний, інформаційний) та доведено важливість використання кожного з них в процесі проведення експертного дослідження. Визначено методи, що застосовуються при вирішенні завдань окремих видів судових експертиз. Effective and efficient expert provision of justice plays an important role in the process of pre-trial and judicial investigation of offenses. However, it is impossible without improving its methodological foundations, which is carried out due to the institutional modernization of the system of expert knowledge and the introduction of methodological tools into expert practice: innovative methods and tools, methods of conducting expert research. In order to conduct a comprehensive, complete and objective expert investigation, it is important to use an effective methodological toolkit with the use of various research methods that complement each other and are necessary for the forensic expert to provide a reliable answer to the questions put to him and to ensure the comprehensiveness and reliability of the conclusions.

    Статтю присвячено дослідженню питань розбудови системи стратегічного моніторингу економічної безпеки підприємств торгівлі в Україні та за кордоном. У статті викладено результати аналізу систем моніторингу загроз у країнах: Швейцарії, Греції, Сполучених Штатів Америки, Королівства Бахрейну, Ірану. Метою роботи є дослідження особливостей забезпечення економічної безпеки підприємств торгівлі в умовах ведення міжнародного бізнесу. Проаналізовано та згруповано ризики та загрози для торгівлі України, що виникають в межах євроінтеграційних процесів. Наявність факторів, що містять в собі загрози та ризики діяльності підприємства торгівлі, актуалізує питання створення системи моніторингу з метою завчасного попередження небезпеки, і вживання необхідних заходів захисту і протидії. Змодельовано процес управління економічною безпекою підприємств торгівлі та систему моніторингу загроз економічній безпеці підприємству торгівлі. The paper is devoted to the study of the development of a system of strategic monitoring of the economic security of trade enterprises in Ukraine and abroad. The paper presents the results of the analysis of threat monitoring systems in the following countries: Switzerland, Greece, the United States of America, the Kingdom of Bahrain, and Iran. The purpose of the work is to study the peculiarities of ensuring the economic security of trade enterprises in the conditions of conducting international business. Risks and threats to Ukraine's trade arising from European integration processes are analyzed and grouped. Among the most significant risks and threats, the following are identified: the need to change legislation in the areas of competition, internal market regulation, environmental safety, lack of funds and specialists to harmonize legislation with EU norms, the presence of asymmetry in the liberalization of the services market and the terms of trade in agricultural goods.

    Функціонування зон duty free та tax free є популярним інструментом у кожній країні світу, вони користуються особливими статусом, який відрізняється залежно від того, де їх розміщено. Статтю присвячено аналізу функціонування зон duty-free та tax-free в Україні та порівнянні їх діяльності з іншими провідними країнами світу. Розглянуто низку документів, які регламентують діяльність магазинів безмитної торгівлі. Показано, які існують проблеми у діяльності магазинів безмитної торгівлі як елементу міжнародної системи роздрібної торгівлі туристичними товарами та наведено конкретні шляхи їх вирішення. In the current conditions of the development of foreign economic relations in Ukraine, the activity of duty-free shops is of particular importance. However, at the moment, the peculiarities of the activity of duty-free shops are practically not covered in the regulatory acts of Ukraine. According to the results of the research, it is worth emphasizing that it is necessary to introduce automatic and transparent VAT refund procedures, as in the EU countries, to introduce new provisions to the Tax Code of Ukraine, which will provide for and describe in detail the features of VAT calculation when supplying goods to duty-free shops trade, it is also important to get rid of smuggling. It is necessary to conduct negotiations to improve the existing free trade agreements between Ukraine and the EU, including to settle the issue of the rules of origin of goods.

    У статті вивчено основні підходи до визначення поняття «просування продукції». Узагальнено, що просування продукції – це комплекс заходів з поширення інформації про продукт, лінійку продуктів, бренд і компанію серед потенційних покупців з метою збільшення продажів і розвитку лояльності до бренду. Виявлено, що просування продукту – це важливий спосіб стимулювання продажів та збільшення доходу для покриття витрат на початкові дослідження та розроблення, витрати на виробництво та випробування продукції. Однак неретельно спланована рекламна кампанія може принести великі збитки. The paper is devoted to the study of the most widespread issues and difficulties of product promotion implementation nowadays, considering current complicated conditions of uncertainty. The paper covers the main definitions of product promotion as the fourth element of the marketing complex, which necessitates the study and generalization of the experience of Ukraine and other countries. The study examines product promotion as an important way to drive sales and increase revenue to cover initial research and development costs, manufacturing costs, and product testing. However, a poorly planned advertising campaign can bring big losses. Therefore, successful product promotion involves creative marketing strategies to increase sales by reaching a specific audience. Product launch and promotion are parts of a manufacturing company's process to increase revenue and brand loyalty. It can also be noted that product promotion is the process by which a company uses the means at its disposal to encourage customers to buy their products. Companies may offer exclusive offers, discounts, and other opportunities for a limited period to entice customers to purchase their product or service. Since customers usually want to receive a favourable offer, it is the quality of product promotion that becomes the determining factor in the process of the customer deciding whether to buy your product or your competitor's product. Promotion is the fourth element of the marketing complex (namely: product, price, distribution, and promotion), which is considered as a method of communication. This element is used by the enterprise to achieve a certain set of goals, such as: providing potential buyers with information about the availability of functions and use of the product; stimulating demand for the product by increasing awareness and interest among customers; emphasizing the difference between the company's product and the competitor's product by creating customer loyalty to the brand; stabilization of sales, emphasizing the importance and features of the product. These goals have shown that product promotion is one of the most important ways to increase the profits of the company and to keep further improvement in difficult conditions.

    Справи за зверненням податкових органів, передбачені ст. 283 КАС України, становлять самостійний різновид судової процесуальної форми адміністративного судочинства. Відсутність у таких справах спору про право дозволяє цей тип провадження віднести до непозовного. Особливості процесуальної форми відбиваються у формі звернення, строках, обмеженні процесуальних повноважень суду на стадії відкриття провадження, доказовій діяльності, судових рішеннях. Загальне позовне і непозовне провадження за зверненням податкових органів співіснують як альтернативні форми судової легалізації застосування обмежувальних заходів. The unity of the procedural form in administrative proceedings is violated by the existence of cases not related to a legal dispute. There are not many such cases, but given the specifics of the configuration of public-law disputes, it can be assumed that they have the potential for further expansion, based on the general trend of strengthening judicial control over the activities of subjects of power. An example of such cases are the cases provided for in Art. 283, CAS of Ukraine. Thus, cases provided for by Art. 283 of the Civil Procedure Code of Ukraine constitute an independent type of judicial procedural form that is implemented within the framework of administrative proceedings – a special non-suitable proceeding.

    У статті досліджено визначення поняття «управління знаннями», цілі та завдання управління знаннями на підприємстві. Проаналізовано систему управління знаннями підприємства та ключові її елементи. З метою організування на підприємстві ефективної системи управління знаннями запропоновано рекомендовану технологію розроблення та впровадження системи управління знаннями підприємства. Ефективне застосування на підприємстві системи управління знаннями дозволить значно знизити ризики ведення бізнесу, покращити швидкість та якість прийняття управлінських рішень, дозволить покращити інноваційну активність підприємства і підвищити його конкурентоспроможність. Today, in the era of the intellectualization of the economy, knowledge management plays an important role in building an effective strategy for the enterprise. The effective application of the knowledge management system at the enterprise reduces business risks, improves the speed and quality of decision-making processes, promotes innovative activity, and leads to an increase in the competitiveness of the enterprise. By applying an effective knowledge management system, an enterprise can achieve significant savings of resources, which is difficult to achieve using traditional management models and methods. Implementation and application of the recommended technology for the development and implementation of the knowledge management system will allow the enterprise to clearly organize the knowledge management system and thus improve the efficiency of operations and achieve resource savings that cannot be achieved using traditional management mechanisms.

    Зазначено, що у сучасних економічних умовах успіх будь-якого підприємства багато в чому залежить від його конкурентної позиції. Акцентовано, що сформована конкурентна стратегія вирішує цілий комплекс завдань, орієнтованих на дослідження довкілля, сегментів ринку, діяльності конкурентів та можливостей підприємства, що дозволить підприємству залишатися гнучким і водночас мати високий рівень фінансової стійкості, платоспроможності, забезпечити високу його вартість, ефективність виробничих процесів та якість продукції, високу конкурентоспроможність на відповідному ринку. It is noted that in modern economic conditions, the success of any enterprise largely depends on its competitive position. Sustainable competitiveness allows enterprises not only to win in the market struggle, but also to take timely measures to respond to changes in the external environment. An effective competitive strategy allows you to get a unique product, the price, quality and properties of which will meet the needs of consumers. The purpose of the paper is to substantiate the theoretical provisions regarding the formation of the competitive strategy of the enterprise. The methodological basis of the research is the scientific works of the classics of economic science, the works and publications of leading scientists and specialists who investigate the issue of forming a competitive strategy of the enterprise. In the research process, such methods as analysis, synthesis, comparison, descriptive- analytical, system-structural were used. It is emphasized that the achievement of strategic commercial goals and the ability to function effectively for a long time are the basis of competitiveness, which for the enterprise, due to its unique properties, surpasses the existing one on the market and is more attractive for consumers in a certain segment of the economy in the long term. The formed competitive strategy for the enterprise has appropriate properties and acts consistently and systematically. It solves a whole range of tasks focused on researching the environment, market segments, competitors' activities, and the company's capabilities. All of them make it possible to implement such a competitive strategy that will allow the enterprise to remain flexible and at the same time have a high level of financial stability, solvency, ensure its high cost, efficiency of production processes and product quality, which, in turn, will allow it to be competitive on the relevant market.
