Abstract
Проаналізовано окремі проблемні питання негативного впливу корупції на права та свободи людини. Розглянуто недоліки антикорупційного законодавства в Україні, назрілі в ній суспільно-економічні проблеми – низький рівень життя населення, бідність, майнову диференціацію соціуму, відчуженість значної кількості громадян від політичного та економічного життя країни, тінізація економіки й легалізація доходів, одержаних злочинним шляхом, як живильне середовище для корупції. Обґрунтовано необхідність запровадження громадського контролю за діяльністю органів публічної влади, посилення організаційної та правової незалежності спеціалізованих антикорупційних органів. Наведено статистику щодо питань, пов’язаних із корупцією. Висвітлено механізми відмивання коштів через корупцію та незаконну економічну діяльність, ризики такого відмивання, зокрема фіктивне підприємництво, ухиляння від сплати податків і шахрайство. Констатовано нагальність запровадження діяльності Вищого антикорупційного суду, що є одним з основних напрямів державної антикорупційної політики. Виокремлено причини невиконання заходів, передбачених засадами державної антикорупційної політики в Україні (Антикорупційної стратегії) на 2014–2017 роки. The article analyses specific problematic issues of the negative impact of corruption on human rights and freedoms, examines the shortcomings of the anticorruption legislation in Ukraine, and socioeconomic problems in Ukraine, i.e. low living standards, poverty, property differentiation of the population, alienation of a significant number of citizens from political and economic life of country, shadowisation of the economy and legalization of proceeds from crime, as factors that are a breeding ground for corruption. The necessity of introducing public control over the activities of public authorities and strengthening the organizational and legal independence of specialized anti-corruption bodies is substantiated. The publication also provides statistics on issues related to corruption in Ukraine, investigates the mechanisms of money laundering through corruption and illegal economic activity, the risks of such laundering, such as false entrepreneurship, tax evasion and fraud; analyses the importance and relevance of the implementation of the High Anti-Corruption Court, which is one of the main areas of state anticorruption policy; the reasons for non-fulfillment of the measures envisaged by the principles of the state anti-corruption policy in Ukraine (Anti-corruption strategy) for 2014–2017 are discussed, and others.
