    НОРМАТИВНО-ПРАВОВЕ ЗАБЕЗПЕЧЕННЯ ПРОВЕДЕННЯ ОЦІНКИ ВІДПОВІДНОСТІ ПІРОТЕХНІЧНИХ ВИРОБІВ. LEGISLATIVE SUPPORT OF THE ASSESSMENT OF CONFORMITY OF PYROTECHNIC ARTICLES

    Research paper highlights the development of a regulatory framework for conducting the conformity assessment of pyrotechnic articles. The mandatory requirements are set out in the regulatory act – Technical Regulation of Pyrotechnic Products, approved by the Decree of the Cabinet of Ministers of Ukraine No 839 dated 03 August 2011. This Technical Regulation has been developed on the basis of the EU regulatory act dated May 23, 2007, concerning the launch of pyrotechnic articles on the market, in accordance with the regulations for drafting Technical regulations approved by the Cabinet of Ministers of Ukraine, on the basis of acts of European legislation of the Union, approved by the Cabinet of Ministers of Ukraine dated June 18, 2012 No 708. Extended requirements for all classes of pyrotechnic articles are set out in national standards, the voluntary use of which gives the presumption of conformity of pyrotechnic articles with the basic safety requirements set out in the aforementioned Technical Regulation. According to the Law of Ukraine “On Technical Regulations and Conformity Assessment”, such national standards should be identical to the relevant European standards adopted in the mentioned EU Directive. According to the Decree of the Cabinet of Ministers of Ukraine of December 16, 2015 No 1057 “On Definition of the Spheres of Activity Where the Central Authorities Perform the Functions of Technical Regulation”, the Ministry of Internal Affairs of Ukraine performs the functions of technical regulation, including the field of pyrotechnic articles, according to which monitors both European legislation and European standards for pyrotechnic articles.

    Використання електронних довірчих послуг у системі МВС України. USE OF ELECTRONIC CONVENTIONAL SERVICES IN THE SYSTEM OF THE MINISTRY OF INTERNAL AFFAIRS OF UKRAINE

    Paper is devoted to the possibilities of use of electronic conventional services, including electronic digital signature, timestamps and electronic seals in electronic documents of state enterprises, state authorities and structures of the Ministry of Internal Affairs of Ukraine. The analysis of the advantages and disadvantages of digital signing is carried out. The ways of introducing alternatives, methods and means of personality identification during signing of electronic documents are considered. The introduction of e-governance in Ukraine without effective and efficient functioning of the electronic document flow system is impossible. Also important for document circulation in electronic form is the proper examination and signing of the document. Taking into account the fact that the scanned document with the signature and seal of the department is not the original document, namely the document signed with the use of electronic digital signature (EDS), according to the Ukrainian legislation will already be legally significant document. In this paper, we will look at and find out, how it is formed, when and why an electronic digital signature is used. In Ukraine, during 2002–2018, a number of legislative acts, normative and technical documents on EDS were adopted and revised. Since that time, this branch has passed the stage of formation and is currently actively developing. We can separately highlight the adopted by the Cabinet of Ministers of Ukraine “Strategy for the Development of the Information Society in Ukraine” of May 15, 2013, No. 386-p. The strategy outlines key areas of innovation: e-government, e-democracy, e-economy, e- commerce, e-service, e-education, e-medicine, e-culture. An increasing number of administrative services are being implemented, which can be arranged electronically, by signing an electronic digital signature. In particular, in the Service Centers of the Ministry of Internal Affairs of Ukraine, citizens have the opportunity to use administrative services, such as: issuing a certificate of legality, which can be taken ready by the chosen, most convenient territorial, service center of the Ministry of Internal Affairs. It can be stated that in order to improve the functioning of EDS in Ukraine, a number of normative acts were adopted in recent years. Ukraine’s progress in the field of information and communication technologies (ICTs) has influenced its assessment in the world.

    Порядок сертифікації продукції на відповідальність вимогам нормативних документів. PRODUCT CERTIFICATION PROCEDURE FOR THE COMPLIANCE WITH REGULATORY DOCUMENT REQUIREMENTS

    Paper deals with one of the aspects of conformity assessment – product certification. Certification – third-party compliance with a product, process, system or personnel, that is, producton as means of assuring that it meets certain requirements of the standards and other regulations. General procedure for product certification is described by the conformity assessment body, which consists of several main stages: application review, evaluation, analysis and decision making on certification. Block diagrams of the stages of the certification of products are given. After receiving the certification application, the CAB registers it and conducts the examination. During the CAB analysis, it should be ensured that: the customer and product information is sufficient for the certification process; any known differences in understanding between the CAB and the client are eliminated; the stated scope of certification is defined; the means available to carry out all the evaluation activities; CAB has the competence and ability to perform certification activities. In case of sufficient competence, certification access bodies make the decision to carry out the certification, otherwise – rejects the application for certification with the reasons given and communicates such decisions to the client. The next step after the certification decision is taken is the assessment process. After the certification agreement (contract) is concluded, the CAB develops an assessment activity plan. During the planning of the evaluation activity, the selection, approval and approval of qualified personnel (expert group) who has the competence in the area specified in the certification application is selected. Assessment of compliance of certification objects with the requirements of ND is carried out through the implementation of measures: consideration of planning documents and ND in terms of performance and product characteristics; sampling and identification of samples of products (samples) that have been submitted for certification; organization of testing, control, conducting audits of the management system, if it is required by the applicable certification scheme. The next stage of the certification work is to analyze the results of the assessment and to make the certification decision. The analysis is carried out by a person (group of persons) who is not involved in the evaluation process and has the necessary competence. Based on the results of the analysis, recommendations are prepared for the CAB management regarding the decision that should be made on the basis of certification results. After making a positive decision on certification, the CAB issues the documents confirming the fact of certification (certificates of conformity), registers them in the register and issues them to the client. In case of negative conclusion about the results of certification, the CAB approves the decision to refuse to issue the certificate with obligatory statement of discrepancies and reasons of negative results of certification and notifies the client.
