    Верховенство права як визначальна конституційна засада вирішення виборчих спорів (методологічні підходи). Rule of Law as a Defining Constitutional Basis for Resolving Election Disputes (Methodological Approaches)

    У статті здійснено аналіз концептуальних підходів до розуміння верховенства права, охарактеризовано особливості цього принципу, а також окресленойого значення для врегулювання виборчих спорів. Мета статтіполягає в тому, щоб на підставі наукових здобутків, правових актів та інших джерел проаналізувати верховенство права як визначальну конституційну засаду вирішення виборчих спорів. Це зумовлює окреслення низки завдань, зокрема: висвітлитибагатоаспектність розуміння однієї з визначальних конституційних засад –верховенства права; з’ясувати специфіку вирішення виборчих спорів; виокремити основні методологічні підходи дослідження зазначеної проблематики та їх перспективні напрями. The article analyzes the conceptual approaches to understanding the rule of law, describes the features of this principle, as well as emphasizes its importance for the settlement of electoral disputes. Thepurpose of the article is to analyze the rule of law as a determining constitutional basis for resolving election disputes on the basis of existing scientific achievements, legal acts and other sources. This presupposes the setting of a number of tasks, in particular: to reveal the multifaceted understanding of one of the defining constitutional principles –the rule of law; to find out the specifics of resolving election disputes; to identify the main methodological approaches to the study of this issue and their promising areas.

    Етичні та правові погляди Піфагора. Ethical and Legal Views of Pythagoras

    Стаття про етичні та правові погляди Піфагора містить інформацію про універсальну систему знань, створену давньогрецьким філософом, мислителем і мудрецем Піфагором, та місце в нійідей і теорій, які стосуються етики й права. Піфагор ніколи не був лише схоластичним теоретиком. Його ідеї, зокрема етичні й правові, втілювалися в практику самим мислителем і його учнями та послідовниками. Важливе світоглядне й практичне значення мають ідеї справедливості та всезагальної любові. Зміст поняття справедливості змінювався і за тисячі років до Піфагора, і за тисячі років після нього. Сучасне розуміння справедливості ґрунтується значною мірою на визначенні, сформульованому в античний період. Нині автори посилаються на Платона, який вважав справедливість доброчесністю, на Аристотеля, котрий пов’язувавсправедливість із заслугами перед суспільством, але не посилаються на Піфагора, який за два століття до названих філософів дав визначення справедливості як відплати рівного за рівне. З огляду на загальне розуміння справедливості Піфагор відкрив новий її вид –законодавчу, яка є навіть кращою за судову справедливість. The article on the ethical and legal views of Pythagoras contains information about the universal system of knowledge created by the ancient Greek philosopher, thinker and sage Pythagoras, and the place in it of ideas and theories relating to ethics and law. Pythagoras was never just a scholastic theorist. His ideas, including ethical and legal,were put into practice by the thinker himself and his students and followers. The ideas of justice and universal love are of great ideological and practical importance. The meaning of the concept of justice changed both thousands of years before Pythagoras and thousands of years after him. Todayʼs understanding of justice is based largely on the definition given in antiquity. Todayʼs authors refer to Plato, who considered justice to virtue, to Aristotle, who associated justice with merit before society, but do not refer to Pythagoras, who two centuries before these philosophers gave the definition of justice as retribution for equal. Based on a general understanding of justice, Pythagoras discovered a new form of it ‒legislative, which is even better than judicial justice.

In Ukraine today, the implementation of reforms in the field of public health services and health care in general, including during the training of specialists in the field of public health services. That is why the whole sphere of medical care should be intensified and follow the established directions of activity, which determine and form certain legal consequences.

    Філософсько-правова рефлексія Конституції Пилипа Орлика як феномену європейського права. Philosophical and Legal Reflection of the Constitution of PylypOrlyk as a Phenomenon of European Law

    У статті проаналізованозначення та роль визначної історичної пам’ятки українського державотворення першої половини XVIII ст. –Конституції Пилипа Орлика в контексті європейської правотворчості. Розглянуто її як важливий політико-правовий документ, щомістить такі елементи доктрини природного права, як: справедливість, гуманізм, повага до прав і свобод людини, рівність перед законом, поділ влади. Метоюдослідження є застосування філософсько-правової рефлексії до з’ясування ролі Конституції Пилипа Орлика в розвитку та формуванні українського та європейського права. The article analyzes the significance and role of the outstanding historical monument of the Ukrainian state formation of the first half XVIII century PylypOrlyk’s Constitution in the context of European lawmaking. It is considered as an outstanding political and legal document, which contains such elements of the doctrine of natural law as justice, humanism, respect for human rights and freedoms, equality before the law, separation of powers. The purposeis to apply philosophical and legal reflection to clarify the role of the Constitution of PylypOrlyk in the development and formation of domestic and European law.
