    Онтологія права як складова філософської онтології (попередні міркування). Ontology of Law as a Component of Philosophical Ontology (Preliminary Considerations)

    Мета – розглянути онтологію права (правову онтологію) як складову філософської онтології, виявити ті характеристики онтології права, які притаманні філософській онтології, і, відповідно, онтології права. Висновки. Взаємозв’язки правової онтології з правовими антропологією, праксе-ологією, теорією практичної діяльності (теорією практичної юридичної діяльності), гносеологією, аксіологією, семіотикою та методологією зумовлені в першу чергу взаємними зв’язками філософ-ської онтології з філософськими антропологією, праксеологією, теорією практичної діяльності, гносеологією, аксіологією, семіотикою та методологією. The purpose is to consider the ontology of law (legal ontology) as a component of the philosophical ontology, identify those characteristics of the ontology of law that are inherent in the philosophical ontology and therefore inherent in the ontology of law. Conclusions. Relationships of legal ontology with legal anthropology, praxeology, theory of practical activity (theory of practical legal activity), epistemology, axiology, semiotics and methodology are prima-rily due to the interrelationships of philosophical ontology with philosophical anthropology, praxeology, theory of practical activity, epistemology, axiology, semiotics and methodology.

    Формальні та неформальні аспекти логіки розслідування. Formal and Informal Aspects of Investigational Logic

    Мета статті полягає у визначенні умов раціонального поєднання формальних і неформальних аспек-тів логічного аналізу, спрямованого на оптимізацію стратегій розслідування. Висновки. Формальні та неформальні підходи до аналізу слідчої діяльності характеризуються наявністю як своїх переваг, так і відповідної методологічної обмеженості. Тож у практиці розслідування доціль-ним є узгоджене поєднання згаданих підходів, з огляду на умови їх релевантності та ефективного застосування. Такі умови визначаються логічною моделлю побудови стратегій слідчо-пошукового процесу, яка презентує динаміку його розгортання як хронологічної послідовності синхронізованих станів «картини» розслідуваних подій, що уможливлює не тільки змістовний, але й структурно-формальний їх аналіз. The purpose of the article consists in defining the conditions of rational combination of formal and informal aspects of logical analysis, aimed at the optimization of investigative strategies. Conclusions. Formal and informal approaches to logical analysis of investigative activity are characterized by the presence of both their advantages and the corresponding methodological limita-tions. Therefore, in the practice of investigation, a coordinated combination of mentioned approaches in accordance with the conditions of their relevance and effective application is appropriate. Such condi-tions are determined by a logical model of building strategies of the investigative process, which presents the dynamics of its development in the form of a chronological sequence of synchronized states of the «picture» of the investigated events, which allows not only substantive but also structural and formal analysis.
