Item Зарубіжні теоретико-правові традиції організації державної влади.Foreign Theoretical and Legal Traditions of Organization of State Power(2018) Кравцова, З. С.; Kravtsova, Z.Стаття присвячена висвітленню зарубіжних філософських і теоретикоправових традицій організації державної влади. Розглянуто юридичну сутність державної влади та її інтерпретацію на різних етапах розвитку людства. Визначено питання взаємозвʼязку державної влади зі світоглядними соціальними орієнтирами. Зʼясовано взаємозвʼязок державної влади й суспільства, аргументовано необхідність упорядкувати в наукову систему знання про владу та зробити їх надбанням громадян з метою більш організованого, культурного, цивілізованого, забезпеченого та вільного життя. Сучасні демократичні процеси вимагають від влади управління з мінімальним застосуванням сили. Громадяни посттоталітарних суспільств досі схильні ототожнювати силу і владу, перехід до нового сприйняття влади потребує тривалого часу, зміни поколінь. Саме такі процеси ми спостерігаємо в сучасній Україні. Суспільство виборює свободу від тотальної влади. Свідченням зазначеного є такі політичні події, як Помаранчева революція 2004 року та Революція гідності 2014 року. Для України, яка знаходиться на етапі реформ, історичний та сучасний досвід організації державної влади зарубіжних країн саме в ціннісному аспекті має важливе значення, оскільки зміни мають стосуватися всіх сфер суспільного життя та реалізації влади як на центральному, так і на місцевому рівнях.The article is devoted to the coverage of foreign philosophical, theoretical and legal traditions of the organization of state power. The legal nature of state power and its interpretation at different stages of human development are considered by author. Issues of the relationship between state power and ideological social orientations are revealed. The correlation between state power and society is explained, the necessity to organize knowledge in the scientific system and make them the property of citizens in order to streamline a more organized, cultural, civilized, secure and free life. Today, democratic processes require the power to govern with minimal use of force. Citizens of posttotalitarian societies tend to equate force and power, and the transition to a new perception of power requires a considerable amount of time, a change in generations. It is such processes that we observe in modern Ukraine. Society fights freedom from total power. Political events, such as the 2004 Orange Revolution and the 2014 Dignity Revolution, may serve as confirmation of this. For Ukraine, which is at the stage of reforms, the historical and contemporary experience of organizing the state power of foreign countries has a particular importance, since the changes should apply to all spheres of public life and the exercise of power both at central and local levels.Item Конструктивна комунікативна політика як модель національної консолідації (на прикладі України).Construction Communicative Policy as a Model of National Consolidation (by the Example of Ukraine)(2018) Савойська, С. В.; Savoiska, S.Досліджено конструктивну комунікативну політику як модель консолідації української спільноти. Більшість непорозумінь, протистоянь і конфліктів спричинена тим, що субʼєкти політичного процесу часто не розуміють один одного, а одне й те саме питання сприймають і трактують по-різному, не усвідомлюють, про що йдеться та як сприймати певну інформацію чи проблему. Розв’язанням цієї проблеми слід вважати конструктивну комунікативну політику, яка здатна подолати суперечності, знайти необхідні аргументи та досягти консенсусу з того чи того проблемного питання. Зʼясовано, що конструктивна комунікативна політика може бути ефективною і раціональною, якщо її здійснюють у демократичній державі. І навпаки, вона може бути неефективною, нелегітимною та ірраціональною, якщо її реалізуватимуть в окупованій, тоталітарній або авторитарній державах. Формування і розвиток конструктивної комунікативної політики залежать від того, яка ідеологія панує в державі та який встановлено політичний режим. Усі складові зазначеної моделі позначаються на її функціонуванні та національній консолідації української спільноти. Національна консолідація залежить ще й від того, наскільки ефективно взаємодіють лідери і члени політичних сил, партій, рухів та організацій, що є носіями різних ідеологій і які діють у складі політичного режиму, який зі зміною влади також нерідко змінюється. Доведено, що конструктивна комунікативна політика можлива, якщо її здійснюють у демократичній державі або певній групі (комуністи, національні демократи, націоналісти та ін.). Якщо до певної групи існує опозиція, яка має інше бачення проблеми, то в її розумінні комунікативна політика втрачає конструктивність, сенс і значення. У цьому сенсі конструктивну комунікативну політику всі групи й спільноти трактують по-різному.In the article the constructive communication policy as a model for consolidation of the Ukrainian community. Attention is paid to the fact that many misunderstandings, conflicts and confrontations going on because of the ambiguity and confusion when the subjects of the political process is one and the same issue is perceived and interpreted differently or do not understand whatʼs going on and how to interpret a particular problem. The way out of this situation is constructive communication policy that is able to smooth out all the rough edges, to find the necessary arguments and reach a consensus with one or more issues. It is alleged that without effective communication policy communication no action at all is impossible, because it consists of the following semantic structural elements, such as introduction of material or an event study the issue and its depth and comprehensive analysis, general consultation, discussion and agreement obscure topics that provide a compromise approach to solving problems is accepted. That is, without a proper and responsible approach to the problem to solve it is impossible. That is, without a rational approach to any problem, including national question can not be the consolidation of the Ukrainian nation, which can only unite on a common basis, providing proper knowledge and perception of the history of the Ukrainian people and its statehood, respect to Ukrainian ancestry, national legislation, the study of state/official language, the language posluhovuvannya and spread it to all areas and sectors of political life, respect for heroes, national values and heritage that should be considered as joint achievements and others. It is proved that a nation can be consolidated on the basis of common history, territory, religion respected formed and developed language, culture, economics, public policy and more successful. However, these components of the communication process can divide Ukrainian community and split the country. It was found that constructive communication policy is successful in the area of energy efficiency and energy savings that can be made together based on mutual respect, cooperation, mutual understanding, trust, using appropriate knowledge, skills and abilities. Having thus agreed within a family, shared house, businesses, educational institutions, public and state institutions can reach an agreement with any issues, including energy.Item Рефлексія сутності та правового змісту громадянства.Reflection of the Essence and Legal Doctrine of Citizenship(2018) Софінська, І. Д.; Sofinska, I.Засадничою метою цієї статті є спроба екстраполювати сутність і правову доктрину громадянства в контексті увідповіднення відносин між людиною, суспільством та державою, збереження єдності комплексу «людина– суспільство–держава» в його перманентному розвитку й цивілізаційних трансформаціях як найкомфортнішого та найбажанішого для кожного. Автор акцентує увагу на основних маркерах визначення сутності громадянства, зʼясування правової сутності цього правового інституту. Класична парадигма аналізованого інституту в значенні «постійного правового та ефективного звʼязку» з будь-якою державою відображена в рішенні Міжнародного суду ООН у справі Nottebohm (Lichtenstein v. Guatemala) 1955 року. Однак параметри цього звʼязку часто є недосяжними для певних категорій людей (апатридів (осіб без визначеного громадянства), біженців, шукачів притулку, внутрішньо переміщених осіб та інших), оскільки вони не володіють тим спектром прав, обовʼязків і привілеїв, які стосуються винятково громадян конкретної держави. Зародження доктрини громадянства повʼязане з містами-державами античної Греції (згодом і Риму), коли пропагували не лише звʼязок між особою та містомдержавою, а передусім приналежність до неї, вірність їй та активну участь у її життєдіяльності. Громадянство уособлювало цінності демократії та правовладдя. Під впливом глобалізаційних, цивілізаційних і міграційних процесів правова сутність громадянства змінюється та потребує перегляду й переосмислення.The primary purpose of this article is to attempt to extrapolate the essence and legal doctrine of citizenship in the context of reconciling the relationship between human, society and the state. We should preserve the unity of the «human-societystate» complex in its continual development and civilization transformations, as the most comfortable and most desirable for everyone. Particular attention is paid to the primary markers of the definition of the essence of citizenship, the clarification of the legal nature of this legal institution. From ancient Greek city-states, the chief business of citizens is to be engaged in political deliberation by voting, by serving on juries (for example in the USA), by participating in public and military service, and to live a self-sufficient life. In core understanding, citizenship is a contract (membership in a community) between a person and the state, where are foreseen mutual rights, duties, and privileges. During last century concepts of citizenship and identity were very popular especially among sociologists (D. Beland, L. Jamieson, T. Marshall, S. Sassen, Ch. Tilly and B. Turner).
