This thesis is a first of law complex research of the Christian impact on the state-building and lawmaking activities in the period of the national liberation movements in Ukraine in 1917-1920 in the domestic philosophy. It was concluded that today there is no philosophical-legal interest in research of the state- and lawmaking processes the in Ukraine of the beginning of the 20th century, and the perspectives of this scientific direction in connection with the development of the national legal science are grounded. The author’s concept is proposed for the current Ukrainian legislation development in the first half of the 20th century in the context of Christian doctrine. National law of the above-mentioned period is considered as a phenomenon of the Ukrainian intellectual culture and also as a social-cultural fact.

Дисертація присвячена аналізу філософсько-правових засад судової влади як соціокультурного феномена. Здійснено детальний аналіз основних теоретичних моделей судової влади, починаючи із традиції Нового часу до сьогодні. Висвітлено світоглядну традицію виникнення, становлення та розвитку судової влади. Проаналізовано філософсько-правові концепції, 19 історичні, політологічні та культурологічні дослідження щодо феномена судової влади, а також зроблено висновок про відсутність комплексних філософсько-правових досліджень у цій сфері та зазначено про необхідність філософського осмислення державно-правових явищ як перспективного напряму розвитку вітчизняної юридичної науки. Окреслено особливості судової влади в умовах транзитивного та інформаційного суспільств. Диссертация посвящена анализу философско-правовых основ судебной власти как социокультурного феномена. Проведен детальный анализ основных теоретических моделей судебной власти, начиная с нововременной традиции до наших дней. Dissertation is concerning on analysis of philosophical and legal grounds of judicial power as a social cultural phenomenon. Дисертація є комплексним дослідженням відображення ідей римського права у вітчизняній філософсько-правовій думці. Зроблено висновок щодо відсутності філософсько-правового опрацювання впливу та рецепції ідей римського права в теоретичній площині у вітчизняному контексті. Обґрунтовано перспективність цього наукового напряму історико-філософсько-правових досліджень. Доведено, що починаючи з ХІХ ст. і до сьогодні ідеї римського права були предметом наукового зацікавлення вітчизняних філософів права, але лише дотично щодо основних наукових орієнтацій. Зазначено, що римське право як культурний феномен та ідеї римського права потребують власне філософського осмислення.Доведено, що римське право можна вважати одним із перших засобів глобалізації європейської культури як цілісності. Римське право в модифікованій формі впродовж багатьох століть було універсальною системою врегулювання міжособистісних відносин. Як навчальна дисципліна римське право є основою європейської класичної юридичної освіти.Диссертация является комплексным исследованием отображения идей римского права в отечественной философско-правовой мысли. Сделан вывод об отсутствии философско-правового исследования влияния и рецепции идей римского права в отечественной теоретической плоскости. Обоснована перспективность научного направления историко-философско-правовых исследований. Доказано, что начиная с XIX в. и до сегодня идеи римского права были предметом научного интереса отечественных философов права, но лишь косвенно по основным научным направлениям. Определено, что римское право как культурный феномен и идеи римского права нуждаются в философском осмыслении. В диссертации обозначены особенности изучения и интерпретации идей и положений римского права профессорами Киевского императорского университета имени Святого Владимира (вторая четверть ХIХ – начало ХХ в.). Констатировано, что отечественная философия права и цивилистика в XIX в. формировались под влиянием правовой науки и права европейских стран. Римско-античное правовое наследие было вплетено в постоянный культурно-правовой диалог с отечественным правом и правоведением.The dissertation is the first comprehensive study of representation of Roman law ideas in the national philosophical and legal thought. The conclusion has been made about the absence of philosophical and legal study of the impact and reception of Roman law ideas in theoretical terms in the national context. The perspective of this scientific field in historical, philosophical and legal studies has been explained. It was proved that since the nineteenth century till present the Roman law ideas were the subject of scientific interest of domestic law philosophers, but only superficial considering the main scientific orientations. It was also suggested that Roman law as a cultural phenomenon and Roman law ideas require a proper philosophical reflection.It was proved that Roman law can be considered as one of the main means of European culture globalization as a whole. For centuries Roman law in a modified form has been a universal system of regulation of interpersonal relations. Roman law as an academic discipline was and remains the basis of European classical legal education.
Філософсько-правовий вимір власності як основи демократії. Philosophical and legal aspects of property as the basis of democracy

Дисертація є комплексним дослідженням історичного досвіду трансформації філософського-правового змісту питань власності на всіх етапах розвитку людства. Визначено, що процеси трансформації питань власності та суспільного устрою держави перебувають у тісному взаємозв’язку. Утвердження повноцінного демократичного суспільства та правової держави неможливе без вирішення нагальних питань власності на умовах толерантності, поваги та рівності суб’єктів права усіх без винятку форм власності, серед іншого й на рівні територіальних громад. Для аналізу змісту й сутності сучасної вітчизняної філософсько-правової доктрини в галузі права власності, за визначенням автора, характерне поєднання застарілої радянської концепції примату загальнонародної власності над приватновласницькою, а також прогресивних ліберальних ідей щодо вільних ринкових відносин. Положення законодавства, якими врегульовано правовідносини у сфері власності, мають колізійних характер, наслідком чого є наявність фактів їх неоднозначного тлумачення в процесі правозастосування. На підставі результатів дослідження внесено пропозиції щодо вдосконалення положень Конституції та законів України, якими врегульовано питання власності. The thesis is a comprehensive study of the historical experience of transformation philosophical and legal content ownership issues at all stages of human development. Established that the processes of transformation of ownership issues and social structure of the state are in a state of interpenetration and interconnection. This trend is clearly decisive influence on ownership of the democratization of society, and vice versa - increasing oppression property rights holders from the state leads to establishing totalitarian rule.

Дисертація є комплексним дослідженням аксіологічного змісту нормотворчості МВС України щодо координації діяльності Національної поліції. Визначено основні напрями дослідження нормотворчої діяльності й окреслено коло вчених, які здійснили вагомий внесок у її осмислення. Проаналізовано особливості законодавчого врегулювання нормотворчості МВС щодо координації діяльності Національної поліції. Сформовано аксіологічну модель відомчої нормотворчості МВС України щодо координації діяльності Національної поліції як систему цінностей-стандартів, принципів і норм оптимізації управління. Здійснено аналіз аксіологічного виміру нормотворчої діяльності МВС України як умови ефективного управління у правоохоронній сфері, та питанням взаємодії норм міжнародного та національного права у нормотворчій діяльності. Узагальнено значення принципів нормотворчості МВС щодо координації діяльності Національної поліції як необхідну умову ефективної нормотворчої діяльності. Розкрито особливості забезпечення законності нормотворчості МВС України щодо координації діяльності Національної поліції. Дисертація присвячена аналізу особливостей вітчизняної юридичної освіти в контексті сучасних світоглядних орієнтирів і детермінант. Здійснено детальний аналіз основних історичних моделей юридичної освіти в європейському культурному ареалі, досліджено юридичну освіту в соціокультурному контексті як організовану систему цінностей і норм. Підкреслено, що в юридичній освіті як в елементі конкретної культурної епохи в концентрованому вигляді фокусуються панівна світоглядна настанова, характер наукової раціональності, образ людини та картина світу. Запропоновано поетапну схему розвитку європейської юридичної освіти: середньовічна, новочасова, сучасна. Доведено, що в сучасних умовах розвитку українського суспільства юридична освіта посідає особливе місце, оскільки вона є однією із найбільш включених до модернізаційних тенденцій, що виявляється у таких формах, як формування глобальних просторів вищої освіти й досліджень, зміни в організаційних засадах діяльності вищих навчальних закладів, поширення нових форм організації навчального процесу. Подчеркнуто, что в юридическом образовании как в элементе конкретной культурной эпохи в концентрированном виде фокусируются господствующая мировоззренческая установка, характер научной рациональности, образ человека и картина мира. Предложенная трехэтапная схема развития европейского юридического образования: средневековая, нововременной, современная. Доказано, что в современных условиях развития украинского общества юридическое образование занимает особое место, его вовлеченность в модернизационные тенденции проявляется в таких формах, как: формирование глобальных пространств высшего образования и исследований, изменения в организационных основах деятельности высших учебных заведений, распространение новых форм организации учебного процесса. Определены основные причины низкой академической мобильности среди отечественных студентов-юристов. This dissertation is concerned on the analysis of the peculiarities of native legal education in the context of modern worldview orientations and determinants. A detailed analysis of the basic historical models of legal education in the European cultural area has been carried out; legal education in the sociocultural context has been studied as an organized system of values and norms. The dominant philosophical orientation, the nature of scientific rationality, the image of a man and a picture of the world are focused in legal education, as in a concentrated form of the element of a particular cultural age. The three-stage scheme of European legal education development has been offered – medieval, Modern Age, present. In today’s conditions of Ukrainian society development, legal education is important because it is one of the most involved in the modernization trends, which reveals in such forms as formation of global spaces of higher education and research, changes in the organizational principles of higher education, spread of new forms of educational process organization.

Представлено цілісне бачення чинників зародження, формування та розвитку двопалатного парламенту. На основі досягнень філософії права, зокрема правової аксіології та правової антропології, аргументовано доцільність та умови його запровадження в Україні. В диссертации осуществлено комплексное философско-правовое осмысление теоретических и практических вопросов бикамерализма в контексте украинского парламентаризма. Представлено целостное видение факторов зарождения, формирования и развития двухпалатного парламента. На основе достижений философии права, в частности правовой аксиологии и правовой антропологии, аргументирована целесообразность и условия его введения в Украине.Thesis presents complex philosophical and legal analysis of theoretical and practical issues of bicameralism phenomenon in the context of Ukrainian parliamentarism. Author provides multiaspectual vision of factors influencing the evolution of bicameral parliament. Grounds for the viability of bicameralism concept implementation in Ukraine are formulated on the basis of achievements of legal axiology and legal anthropology.

У роботі визначено сутність, структуру та функції семіотики права як галузі знань і методологічної парадигми новітнього філософсько-правового дискурсу. Доведено, що право як соціокультурне явище, форма суспільної свідомості й нормативний регулятор відносин між людьми має знаковий характер. Висвітлено феномен права в контексті семіотико-правового підходу. Розкрито структуру правової реальності як знакової системи. Сформульовано дефініцію та класифікацію правових знаків. Розглянуто базові складові правової системи України як правові знакові конструкції. За допомогою семіотико-правової методології окреслено перспективні напрями реформування правової діяльності в сучасних умовах. In the first thesis chapter the theoretical-methodological preconditions of semiotic-legal researches formation are described. It is grounded that the diversity of semiotic-legal ideas regarded as the original achievements of the later epochs thinkers, in particular, as for the nature and essence of the sign and presence of clear parallels between the universal sign organization of human being and the symbolic reality of political-legal events, originates to the antique and medieval philosophic inheritance. The modern semiotic researches are grounded to have a pragmatic character and the East-European semiotic tradition is proved to be concentrated on the cultural and art-criticism aspects of the sign systems researches. The heuristic potential of the semiotic approach to a social-cultural scope research and the development insufficiency of the semiotics of law constitutional basis are demonstrated. Дисертація є комплексним дослідженням, в якому здійснено цілісний філософсько-правовий аналіз і наукове осмислення взаємодії права та моралі в сучасному інформаційному суспільстві, виявлені зв’язки між розвитком інформаційного суспільства та тими викликами, що постають у морально-правовій сфері. У дисертації сформулювало ряд концептуальних положень, висновків і рекомендацій, що мають важливе теоретичне та практичне значення. Обґрунтовано процес конвергенції юридичного позитивізму та теорій природного права, окреслено морально-правові засади розвитку інформаційного суспільства та визначено коло проблем, що породжуються впливом новітніх інформаційно-комунікативних технологій на традиційні духовні цінності. Запропоновано практичні заходи державної політики в сфері захисту суспільної моралі та подальшого удосконалення правового регулювання інформаційних відносин в Україні. The thesis is a complex study in which a cohesive philosophical and legal analysis and scientific understanding of the interaction of law and morality in the modern information society is carried out, the links between the development of the information society and those challenges that appear in the moral and legal sphere are revealed. In the dissertation a number of conceptual provisions, conclusions and recommendations, which have important theoretical and practical significance are formulated. The substantiated process of convergence of legal positivism and the theory of natural law, the moral and legal foundations of the development of the information society are defined and the range of problems created by the influence of the latest information and communication technologies on traditional spiritual values has been established. Practical measures of state policy in the field of protection of public morality and further improvement of the legal regulation of information relations in Ukraine are proposed. У роботі досліджено філософсько-правові засади генезису суспільних відносин у процесі формування правосвідомості людської особистості. Здійснено філософсько-правове осмислення процесу формування правосвідомості особистості та доведено, що рушійною силою цього процесу є виховний вплив сім’ї, школи, суспільства, а його кінцевою метою – соціалізація молодої людини як особистості до самостійного дорослого життя в умовах зовнішнього оточення, залучення до активного громадського життя. Встановлено, що формування правосвідомої людської особистості, здатної протистояти негативним викликами сучасної складної соціально-політичної та економічної ситуації має стати прерогативою державної політики в галузі навчання виховання та отримання освіти. В работе исследованы философско-правовые основы генезиса общественных отношений в процессе формирования правосознания человеческой личности. Осуществлено философско-правовое осмысление процесса формирования правосознания личности и доказано, что движущей силой этого процесса является воспитательное влияние семьи, школы, общества, а его конечной целью – социализация молодого человека как личности к самостоятельной взрослой жизни в условиях внешнего окружения, привлечение к активной общественной жизни. Установлено, что формирование правовосознательной человеческой личности, способной противостоять негативным вызовам современной сложной социально-политической и экономической ситуации должно стать прерогативой государственной политики в области обучения воспитания и получения образования.In the first thesis chapter of the scientific work the author studies historical sources and defines the theoretical and methodological principles of the study deals with the philosophical and legal and methodological foundations of the research, analyzes the works of the classics of philosophy, psychology and jurisprudence on issues relating to all components of the system of education, education and education, both in their interrelationship and in relation to the specific features of each of them. The historical analysis of the main stages of development of the processes of education, education and acquisition of education as the main factors of the formation of the personality consciousness is carried out. The conclusion is that the process of formation of the person’s legal consciousness as a philosophical and legal category and a psychological phenomenon should be realized in accordance with generally accepted criteria of lawful behavior and legal culture in the relations between the individual and the society. In the second chapter on the basis of the study of the philosophical works of the antique, medieval thinkers and contemporary and specialists in the field of sociology, the author offers his understanding of the essence of the ontological aspects of the process of forming a personality, which although possesses signs of epistemological, in his opinion, is not a simple acquisition and mastering of knowledge, but is determined how the purposeful influence on the individual in order to assimilate him the rules of conduct necessary for integration into society. It is emphasized that the value of the right lies in the fact that legal ideology, as a component of legal consciousness, is an inalienable regulator of the behavior of the individual. Values of education have a significant impact on the formation of the human person, since they regulate interaction in the educational sphere and form the mutual relations between a person and society. It has been established that psychological influence is always present in educational and educational processes. The method of formation of the children and youth organizations under the control of the authorities as a form of state idol and psychological influence on the society as a whole and on each of its members is explored. In the third chapter of the thesis study the philosophical and legal peculiarities of the transformation of the educational process in Ukraine in the Soviet and post-Soviet times, characterized by a different ideology, are revealed. It was established that the priority direction of the reformation of education in an independent state is the development of a national education system taking into account fundamental changes in all spheres of public life. Currently, national educational legislation includes European standards for the formation of a legal personality and contains many positive characteristics, but the domestic education system, as part of the process of formation of a human person, needs further reform. The role of legal education in the formation of a person’s outlook and proved that corruptive manifestations in the system of education have been substantiated, have a negative influence on the process of forming a person’s legal consciousness In the fourth chapter of the scientific work analyzed with legal education as the determining factor in the relationship between the human person and the society, which contains an axiological component, since it is intended to protect the values of being and is based on universally recognized principles of law: the rule of law, justice, freedom, equality, humanity, the rule of law, which determine the formation of a law-conscious person. The role of the family, school, and society in the formation of the personality legal consciousness has been determined, and the philosophical and legal substantiation of the concept of the triadity of these subjects has been made, which should become the basis of the corresponding state program. The peculiarities of the process of formation of legal consciousness in some segments of the population of modern Ukrainian society by the example of the inhabitants of rural areas are analyzed and determined, and it was emphasized on the necessity of taking measures aimed at raising the level of legal consciousness of the rural population. In the fifth chapter of the thesis it is devoted to studying the experience of forming a person’s legal consciousness in the EU countries and the influence of European experience on the Ukrainian practice of forming a person’s legal consciousness, in particular. Аnalyzed European experience in forming the personality of justice in educational institutions of the Ministry of Internal Affairs, which may be useful for Ukraine. The circle of organizational and legal measures for implementation of the concept of the three main subjects of the process of forming the personality of a person in the life of modern domestic society is outlined. Дисертація присвячена дослідженню філософсько-правових засад та процесуальних вимог щодо формування доказової бази при розгляді справ з питань, що віднесені до юрисдикції конституційного судочинства як форми захисту прав і свобод людини і громадянина. В роботі розкрито сутність, зміст і світоглядні основи дослідження феномену доказування у конституційному судовому процесі. Проаналізовано гносеологічний зміст судового пізнання, враховуючи специфіку діяльності органу конституційної юрисдикції. Охарактеризовано теоретико-методологічний та практичний рівні доказування як форми юридичного пізнання в судовому конституційному процесі. Розкрито сутність філософсько-правових засад доказування в європейських та міжнародних судах при здійсненні наднаціональної юрисдикції. Досліджено коло джерел доказів та визначено їх епістемологічно-правові характеристики як основи доказування у конституційному судовому процесі. За результатами дослідження зроблено висновки про необхідність суттєвого удосконалення наукової та законодавчої бази діяльності Конституційного Суду України.Диссертация посвящена исследованию философско-правовых основ и процессуальных требований по формированию доказательной базы при рассмотрении дел по вопросам, которые отнесены к юрисдикции конституционного судопроизводства как формы защиты прав и свобод человека и гражданина. В работе раскрыто сущность, содержание и мировоззренческие основы исследования феномена доказывания в конституционном процессе. Проанализировано гносеологическое содержание судебного познания, учитывая специфику деятельности органа конституционной юрисдикции. Охарактеризовано теоретико-методологический и практический уровни доказывания как формы юридического познания в судебном конституционном процессе. Раскрыто сущность философско-правовых основ доказывания в европейских и международных судах при осуществлении наднациональной юрисдикции. Исследовано круг источников доказательств и определены их эпистемологическо-правовые характеристики как основы доказывания в конституционном процессе. По результатам исследования автор делает выводы о необходимости существенного усовершенствования научной и законодательной базы деятельности Конституционного Суда Украины.The dissertation is devoted to the study of the philosophical and legal framework and procedural requirements for the formation of an evidence base in the consideration of cases on matters that are within the jurisdiction of constitutional legal proceedings as a form of protection of the rights and freedoms of man and citizen. According to the results of the study, the author makes conclusions about the need for a substantial improvement of the scientific and legislative framework for the activities of the Constitutional Court of Ukraine. The main ones are this. The characteristic features of philosophy and ideological content of evidence in the domestic constitutional court process are its orientation towards the protection of human and civil rights and freedoms guaranteed by the Constitution. The methodology for the study of the philosophical and legal foundations of evidence in a constitutional court process should be defined as a set of methods of research used in modern domestic and foreign jurisprudence. It is based on mental thinking and an outlook based on the ideology of human recognition, life and dignity, inviolability and security of the highest social value. Proof in the domestic constitutional court process is subject to general epistemological laws and is understood as the creative activity of judges and process participants, while the axiological dimension of evidence and evidence in this process depends on the essence and content of the values of constitutionalism, and ontological - with the definition of the notion of the existence of law, its properties in understanding the essence and existence in realities of socio-political conditions of life of society.

The dissertation is devoted to the study of the philosophical and legal principles of the formation and development of the information society in Ukraine. It is researched the legal grounds that led to the rapid and unceasing progress of information and communication technologies and their influence on philosophical, legal, social, economic, political, ethical, moral, cultural, educational and other dimensions of the life of society. The generalizations about the essence of the information society are made; the national, regional and global features of its development are studied; the prospects for the development of the information society in Ukraine are marked and a prognostic analysis of the possible negative and positive consequences of such development in the context of globalization and virtualization of all spheres of public life is given. At the conceptual level, problems related to the formation of an optimal state information policy are investigated, including, in particular, the creation of e-jurisdictions, ethical and legal regulators of the Internet, e-governance in Ukraine, provision and dissemination of information services, are explored. It is paid particular attention to protecting the right to reliable and timely information as one of the fundamental human rights and citizen and the prospects of transforming the information society into a knowledge society. It is emphasized that the information society was preceded by the ever-increasing development of computer technology and computer science, but the very concept of the information society was shaped by the ideas of improving the living conditions of the individual, harmonizing his relationship with society, which a priori implies high morals, a culture of behavior and respect for universal values. Historical analysis of the development of human civilization shows that the introduction of advanced technologies has «two sides of the medal», on the one hand, these are new benefits and opportunities, on the other hand, negative phenomena, which are often accompanied by criminal manifestations, both in relation to the individual and social groups, so and humanity as a whole. Although technical progress can not be stopped, it is possible and necessary to introduce a system of measures for the formation of the information and legal culture of the individual and society through knowledge integration combining the axiological and ontological philosophical dimensions of lawful activity and behavior in the information society as a counteraction to the unjustified use of IT. The common feature of all legal systems today is that in the information society more intensive than in the industrial, there is a division of society into two main classes. It is a class of intellectuals, knowledge carriers, and a class of those who are not part of the new information economy, whose dominant product is information with a short life cycle. One consequence of such a distinction is the attitude of representatives of the intellectual elite to «computer ignorance», which in turn is one of the reasons for the widespread spread of the information offenses. Unlike Western European countries, Ukraine lags far behind the introduction of e-governance, which is one of the main reasons for the significant fraction of the corruption component in the activities of executive authorities, local self-government, their officials, lack of educational level, in particular the level of «computer literacy». Despite the obvious positive features of the information society, it becomes clear today that its transformation into a knowledge society, including in Ukraine, is not a question of the nearest future. The main factors that became an obstacle in this way are the formed consumer worldview of a significant part of IT users, the traditional use of science and technology achievements for humanity is not for their direct purpose, but primarily for military purposes, the economization of information, the use of information processes mainly for the purpose optimization of production, which de facto led to the transformation of information into goods not knowledge. It is proved that the formation and development of the information society in modern conditions, in particular in Ukraine, led to the transition to a new phase of social transformation - post-information society, or media society which focuses not on objective information but on a display information product, widespread media, including for the purpose of manipulating the mass consciousness. In such a media society the difference in terms of information, misinformation, defamation is not principle. In fact media and their information content today absorb the person's need for basic knowledge. The worldview of a person in a media society is shaped in such a way that he is primarily interested not in receiving information but in communication, and uses information and communication technologies as a means of data exchange and a means of influence, transforming his own real life into a virtual scenario offered by the media. Ukraine has to determine what path to choose for the further movement in the information society – to provide maximum freedom of information or its dosage. People should have the opportunity to think freely, fearlessly, openly express their thoughts, and freely dispose of their strengths, abilities and property. Freedom of information may be limited solely in the interests of freedom.

У дисертації здійснено комплексне наукове дослідження реалізації права в сучасному правовому розвитку. Аспекти реалізації права висвітлено з позицій природно-правового й аксіологічного підходів, що надало можливість подолати державоцентристську сутність цього елементу правової реальності й виявити його глибинно гуманістичну сутність. Запропоновано переосмислене визначення поняття реалізації права як процесу втілення в життя смислів і принципів права безвідносно до форм його буття. Обґрунтовано, що природно-правовий підхід надає можливість відрізнити правове регулювання від державно-владного свавілля, а механізм правового регулювання – від механізму свавільно-маніпулятивного регулювання. Досліджено чинники, що становлять перешкоди для реалізації права в сучасній Україні. Запропоновано можливі шляхи їх подолання. В диссертации осуществлено комплексное научное исследование реализации права в современном правовом развитии. The complex scientific research of realization of the right in modern legal development is carried out in the thesis. The aspects of the implementation of law is highlighted from the standpoint of natural-legal and axiological approaches, which makes it possible to overcome the state-centric essence of this element of legal reality and to reveal its deep humanistic essence. The reassesed concept of realization of the right as the process of realization of the meanings and principles of the right irrespective of the forms of its existence is offered. It is substantiated that the natural-legal approach allows to distinguish legal regulation from the state arbitrariness, and the mechanism of legal regulation – from the mechanism of arbitrary-manipulative regulation. The factors that constitute the obstacles to the implementation of law in modern Ukraine have been studied and possible ways to overcome them are suggested.

Дисертація є філософсько-правовим дослідження феномену правових цінностей в аспекті їх дуальної природи: правові цінності є ідеалами та компромісами одночасно. Правові цінності-ідеали виконують впорядковальну функцію соціального простору, є результатом конкретного соціокультурного контексту, квінтесенцією культури. Вони є основоположними орієнтирами правового життя. Правові цінності-компроміси виконують технічні завдання і детермінються конкретним юридичним простором. У роботі проаналізована специфіка сучасних правових цінностей через призму інтеграційних і глобалізаційних процесів; відмінність світоглядно-настановчого комплексу європейської і неєвропейських культур. Розглянуто особливості універсальних і фундаментальних правових цінностей. Особлива увага була приділена правам людини як правової цінності сучасності. На основі текстуального аналізу міжнародних та вітчизняних нормативних актів виявлена специфіка таких цінностей-компромісів, як приватне життя та толерантність. Диссертация является философско-правовым исследованием феномена правовых ценностей з позиций их дуальной природы: правовые ценности являются идеалами и компромиссами одновременно. Правовые ценности-идеалы выполняют структурирующую роль в организации социального пространства, они – результат конкретного социокультурного контекста, квинтэссенция культуры. Также они выполняют роль основоположных ориентиров в правовой жизни общества. Правовые ценности-компромиссы призваны выполнять технические задания и детерминируются конкретным юридическим пространством. В работе проанализирована специфика современных правовых ценностей посредством осмысления глобализационных и интеграционных процессов; отличия мировоззренчески-установочного комплекса европейской и неевропейских культур. Рассмотрены особенности универсальных и фундаментальных правовых ценностей. Особое внимание было уделено правам человека в качества правовой ценности современности. На основе текстуального анализа международных и отечественных нормативных актов определена специфика таких ценностей-компромиссов, как личная жизнь и толерантность. The thesis deals with the research of legal values from a philosophical and legal position. The ideological tendencies that have determined the emergence, formation and functioning of legal values, as well as their role in modern society are described. It has been emphasized that modern trends in the development of the world community and the Ukrainian one in particular are characterized by serious changes in all spheres of public life, including legal. These changes are determined by the dominant value and worldview structure of a particular society, and in the context of globalization and standardization, the most general value and worldview guidelines for modern mankind are traced.

У дисертації зазначається, що система правосуддя Давньої Греції досить якісно та суттєво відрізнялася від аналогічних систем Давнього Єгипту та Вавилону. Проаналізовано особливості давньогрецької філософсько-правової традиції у сфері судочинства часів ахейського та дорійського періодів. Розглянуто судову систему Афін, ідеологію правосуддя у Спарті. Підкреслюється, що Сократом залишено поза увагою психологічний аспект діяльності суду. Указується на те, що на переконання Платона суддя мусить володіти не лише широкими повноваженнями, але й необхідними особистими якостями морально-етичного характеру. Зазначається, що Арістотель робив наголос на тому, що правосуддя (правосудність) покликане визначити і встановити загально-соціальні, спільні джерела й основи справедливості. У свою чергу Епікуром феномен правосуддя сприймався у якості неприродного явища. Стоїки перебували на жорстких позиціях щодо проблематики злочину та покарання. Натомість скептики, не сформулювали логічно виваженого та всезагального поняття справедливості. Указується на те, що у Конституції України знайшли власне відображення основоположні принципи діяльності судової системи, розроблені ще за часів Давньої Греції. The paper under studies is a complex research of the phenomenon of philosophical and legal basics of the Ancient Greek justice. Despite the fact that today the issue under discussion is acquiring more and more significance, it has been insufficiently investigated in the works by Ukrainian and foreign scholars, particularly in theoretical and practical aspects. Consequently, it is subject to actualization and requires a thorough comprehensive analysis. The thesis points out that the system of justice in Ancient Greece was significantly different from the similar systems of ancient Egypt and Babylon. These differences are caused by the higher onto-axiological development of the justice system that existed in Ancient Greece. The Ancient Greek philosophical and legal tradition in the field of justice of the Achaean and Dorian periods is the result of the synthesis of a large number of components that are an integral attribute of any society. The judicial system of Athens contained the elements of direct democracy, which indicates a high degree of development of state democratic institutions. The jurisdiction of the court included the right to authorize the review of decisions of the National Assembly for their compliance with the principles of the state system of Athens, thus creating an analogue of the modern constitutional court. The very principles of the highest judicial body in Athens can be regarded as one of the means of combating corruption. In addition, this body also acted as an appellate court. It is pointed out that the ideology of justice in Sparta, on the one hand, stipulated a tendency to judicial arbitrariness and, at the same time, contained certain reliable legal mechanisms to ensure or minimize its spread in the state. On the other hand, the military organization of Sparta did not synthesize favorable foundations for the intellectual development of society, let alone its creative enrichment and social culture. It has been ascertained in the paper that Socrates quite carefully and thoroughly developed the logical and axiological content of such philosophical and legal categories as wisdom, justice and charity, with a direct projection of these phenomena on the sphere of social life. The thinker emphasized that the law is the axiological absolute that lays foundation for constructing the ontological essence of society on the whole, and the individual in particular. Nevertheless, philosopher ignored the psychological aspect of the court, which resulted in the death sentence against Socrates himself. Socrates has indirectly acknowledged that the psychological aspect of the court plays a very significant and sometimes fatal role. In his turn, Plato sought to draw a parallel between the divine origins of the laws and called particular attention to the existence of a divine component in the administration of justice. Apart from that, he was convinced that any judge could decide on a case and eventually achieve a wide variety of results, which would prove his level of professionalism and adherence to the postulates of justice. According to the philosopher, the judge must possess not only broad powers, but also the necessary personal qualities of moral and ethical nature. Besides, Aristotle outlined that justice is nothing but an expression of beauty, its material manifestation. Therefore, any judicial decision is designed to identify and determine such universal social, common sources and basics of justice that are understandable and acceptable to the majority of society. The philosopher also made a peculiar reservation in regard to the following: what is legal is fair (just) only if there is a certain subjective recognition of it, that is, legal only in a subjective and not an objective sense. As to Epicurus, he perceived justice as an unnatural phenomenon created by the state in order to serve its own interests, as well as to endow it with a certain amount of punitive functions. The representatives of the philosophical school of Stoicism kept to a rigid stance on the problem of crime and punishment, which was clearly explained by their understanding of the very phenomenon of human duty, the latter’s essence lying in the fact that the individual should live up to all his obligations. Instead, the ideology inherent in skepticism was not able to articulate a logically balanced and universal notion of justice. It is essential that the basic principles of the judicial system of the state, developed by Ancient Greek philosophers and tested in the Athenian state, have not lost their relevance so far and today continue to act as the basis of the judicial systems of most countries and international courts. The Constitution of Ukraine reflects the fundamental principles of the judicial system, developed in the days of Ancient Greece, as well: the equality of all participants in the judicial process before the law and the court; adversarial nature of the parties and their freedom to present their evidence to the court and to prove their persuasiveness before the court; providing the accused with the right to defense; publicity of the trial; binding nature of the court decision and the possibility of a collegial hearing of the case, or a trial by a jury.
