І.; Podik, I.Констатовано, що комунікативно-дискурсивна методологія спрямована на аналіз теоретичного та практичного юридичного нормотворення як універсального способу пізнання юридичної дійсності. Розглянуто особливості правозастосування норм у судовій практиці, що передбачає обґрунтованість й аргументованість звинувачень, а також їх спростування. Доведено, що важливою професійною рисою сучасного юриста є вміння здійснювати семантичний аналіз висловів природної мови.It is proved that communicative-discursive methodology is aimed at the analysis of theoretical and practical juridical regulations formation, as the general means of juridical reality cognition. Juridical norm as one of forms of coordination social relations regulation between people, among public society and the state and international relations is not self-sufficient trick of good or evil intention of form creation subject, but always is grounded on political appropriateness and requires approval (positive or negative) of social environment. In this sense the problems of juridical norm formation require not only declarative-imperative emphasis, but also their logic – discursive analysis. In the sphere of law and our context of philosophy and law methodology of juridical regulations formation of communicativediscursive analyzer, juridical language is of immense significance in preserving integrity of law-making system, which fundaments the state. The effectiveness of its legislative, law enforcement function in relations with public society directly depends on professionally intelligent of the composed juridical norm. In the given context this is projection of desired for its forming subject of the citizens’ behavior that coordinates their needs and interests. It is proved, that one of the major professional characteristics for a modern lawyer is the ability to carry out semantic analysis of natural language expressions.Item Теоретична типологія в стратегії наукового пошуку .Theoretical Typology In the Scientific Search Strategy(2017) Демидова, И. Визначено її співвідношення з іншими дослідницькими процедурами – класифікацією, систематизацією, моделюванням. З’ясовано сутність, можливості, принципи й обмеження теоретичної типології в контексті правових досліджень. Проанализирована совокупность базовых понятий и характеристик, свойственных типологии. Определено соотношение ее с другими исследовательскими процедурами – классификацией, систематизацией, моделированием. Определены сущность, возможности, принципы и ограничения теоретической типологии в контексте правовых исследований.The article deals with the complex of basic concepts and characteristics peculiar to typology. It is correlated with related to its research procedures – classification, systematization, modeling. It determined the essence, possibilities, principles and limitations of the theoretical typology in the context of legal research. The strategy means the integrated model of action, on-governance to achieve these goals. The value of the typology as a special methodological tool is the ability to use it for building a theoretical explanation. The article establishes the importance of the concepts of «type», «class». A saving provision in the theoretical sense there is formed a scientific category of Criminalistics, and from the practical aspect can be described as the activity of development and considers recommendations, based on the theoretical basis of forensic science to investigate the crimes. Today, the following tasks are complicated by the need to investigate the crimes committed, which has the means and methods of criminal activity, as well as various manifestations of international crime. The existing differences regarding the interpretation of the notion of criminal content and directions of its implementation due to the fact that insufficient attention is paid for the coverage of its own methodological issues, which constitute the basis of any scientific research and effective practice. Визначено комплекс наукових методів, використання яких спрямоване на з’ясування сутності окремих правових категорій з досліджуваної проблематики.Given that the basis of any scientific study is a learning process, the question of definition methodological principles of research guarantees the rights of juvenile suspects and their implementation during the preliminary investigation of particular importance and requires a separate scientific analysis. After all, science is gaining objective knowledge of phenomena and processes only if received proper methodological basis.
