Проведено розмежування досліджуваного складу злочину від суміжних злочинних посягань. Доводиться відповідність положень ст. 239-2 КК України положенням Основного закону України, а також її унікальність у сфері кримінально-правової охорони прав громадян, що гарантовані Конституцією України. The article analyzes the compliance of section VIII "Crimes against the environment" Special part of the Criminal Code of Ukraine, including the provisions of Art. 239-2 of the Criminal Code of Ukraine prescriptions of the Constitution of Ukraine. A distinction was made between the investigated crime and related criminal offenses.
