У статті досліджено проблемні питання нормативної регламентації захисту прав людини під час проведення негласних слідчих (розшукових) дій, пов’язаних із втручанням у приватне спілкування, які можуть обмежувати права особи і громадянина. Так, процесуальні дії, під час яких має місце обмеження прав та інтересів осіб, проводяться лише з дозволу та на підставі ухвали слідчого судді апеляційного суду. До того ж забороняється використання інформації, отриманої внаслідок втручання у спілкування, не інакше як для вирішення завдань кримінального провадження. According to the provisions of the Criminal Procedure Code (CPC) of Ukraine, the prosecution is obliged to use all opportunities provided by law to respect the rights of the parties to criminal proceedings (in particular, observance of the principles of secrecy of communication and non-interference in private life). The paper examines the problematic issues of normative regulation of human rights protection during covert investigation (search) actions related to interference into private communication, which may restrict the rights of an individual and a citizen. Thus, procedural actions, during which there may be a restriction of the rights and interests of persons, are carried out only with the permission and on the basis of the decision of the investigating judge of the appellate court.
