У цьому дослідженні ми виходимо з того, що функції права детерміновані наявним типом суспільства, який, у свою чергу, впливає на всю сукупність сформованих правових відносин та знаходить своє відображення у проявах права і правосвідомості. Оскільки право за своєю сутністю не є тотожним лише етиці моральних суджень, воно не втілюється виключно у формі природного права. Також воно не набуває свого вираження і в так званому позитивному праві, формалізованому у вигляді законодавчих актів, адже законодавчий припис не завжди відповідає праву. Тому більш релевантним є розгляд права і правосвідомості як взаємопов’язаних і цілісних явищ, які належать до сфери сущого та перебувають у тісному взаємозв’язку із суспільними відносинами, на відміну від зайвого моралізування права чи то позитивістського його зведення виключно до змістовної частини законодавства. The article deals with the category of «non-law». In this study, the author proceeds from the fact that the functions of law are determined by the existing type of society, which, in turn, affects the entire set of formed legal relations and is reflected in the manifestations of law and legal awareness. Since law is not identical only to the ethics of moral judgment, it is not embodied solely in the form of natural law. It also does not take its form in the so-called positive law formalized in the form of legislative acts, because the legislative prescription does not always correspond to law.
