Загальними підставами звільнення у зв’язку із зміною обстановки слід вважати умови, які передбачені в ст. 48 КК України, що особа повинна вчинити злочин вперше, невеликої або середньої тяжкості, крім корупційних діянь. До спеціальної підстави звільнення від кримінальної відповідальності за ст. 48 КК України належить зміна обстановки, що може проявлятись або у втраті суспільної небезпечності діяння або втраті суспільної небезпечності особи. Зміна обстановки, внаслідок якої вчинене особою діяння втратило суспільну небезпечність, означає передусім істотну зміну соціально-економічних, політичних або духовних засад життєдіяльності суспільства, яка відбувається незалежно від волі винної особи і внаслідок чого втрачається суспільна небезпечність не лише конкретного злочину, а й подібних йому діянь. The article analyzes the institute of release from criminal liability due to the change of the condition. The general grounds for release due to the change of the condition should be considered the conditions provided for in the Article 48 of the Criminal Code of Ukraine, that a person has committed a crime of a small or moderate gravity for the first time, except of corruption acts. To the special ground of release from criminal liability according to the Art. 48 of the Criminal Code of Ukraine belongs the change of the condition, which may manifest itself either in the loss of public danger of the action or the loss of social danger of a person.
