ДЕМИДЕНКО ВолодимирDEMYDENKO Volodymyr2024-07-102024-07-102024https://elar.naiau.kiev.ua/handle/123456789/32638Нині європейська спільнота чітко усвідомлює, що агресивна війна РФ проти України є не лише загрозою існування суверенної держави та геноцидом українського народу, а й має за мету руйнування європейських цінностей щодо демократії, свободи, верховенства права та ліквідацію створених на цих принципах міжнародних міжурядових об’єднань держав (Рада Європи, ЄС та НАТО), мінімізацію їх геополітичного значення. Таке розуміння терористичної сутності РФ системно окреслено в правотворчості уповноважених інституцій ЄС, ОБСЄ та Ради Європи, спрямованих на підтримку України. Звичайно, євроінтеграційний курс України не лише обумовлює реформування в умовах війни національного муніципального права України, а й потребує вдосконалення європейського муніципального права (у межах держав – членів Ради Європи). Відповідно, виникає потреба в аналізі сучасного стану реформування європейського муніципального права та муніципального права України. Метою публікації є дослідження впливу євроінтеграційного курсу України на європейське та національне муніципальне право в умовах сучасної російської гібридної війни. Методологію дослідження становить система теоретичних принципів (історизму, об’єктивності, плюралізму тощо), логічних прийомів (аналіз і синтез, індукція та дедукція, аналогія, гіпотеза тощо) і конкретних засобів дослідження, що надали можливість повноцінно окреслити тенденції модернізації сучасного європейського та національного муніципального права. Наукова новизна публікації полягає в тому, що вдосконалено науково-теоретичне уявлення про взаємозв’язок впливу євроінтеграційного курсу України як на муніципальне право України, так і на європейське муніципальне право. У результаті дослідження проаналізовано модернізацію європейської безпекової й оборонної політики з огляду євроінтеграційного курсу України та гострої потреби протидії російській гібридній війні проти європейських цінностей. Практична значущість статті полягає в тому, що констатовано наявність окремих негативних тенденцій в сучасній європейській муніципальній політиці, пов’язаних з непоодинокими перемогами ультраправих проросійських політичних сил і рухів у низці європейських держав як на місцевих виборах, так і вже на загальнодержавних. Accordingly, there is a need to analyze the current state of reforming the European municipal law and the municipal law of Ukraine. The purpose of the publication is to study the impact of Ukraine's European integration course on European and national municipal law in the conditions of the modern russian hybrid war. The research methodology is a system of theoretical principles (historicism, objectivity, pluralism, etc.), logical methods (analysis and synthesis, induction and deduction, analogy, hypothesis, etc.) and specific means of research, which made it possible to fully reveal the modernization trends of modern European and national municipal law. Scientific novelty. The publication improves the scientific and theoretical understanding of the relationship between the impact of Ukraine's European integration course on both Ukrainian municipal law and European municipal law. Research results. The modernization of the European security and defense policy is analyzed from the point of view of the European integration course of Ukraine and the urgent need to oppose the russian hybrid war against European values. Practical significance.
