Уніфікований патентний суд є самостійною інституцією, яка встановлена внаслідок підписання державами-членами Європейського Союзу міжнародної угоди між собою. Втім його становлення та майбутнє функціонування тісно пов’язані з правовим порядком Європейського Союзу та досягненням цілей установчих договорів. У статті досліджено значення правового порядку Європейського Союзу для становлення унітарної системи патентного захисту в Європейського Союзу та зокрема Унітарного патентного суду. The article examines the establishment of the Unified Patent Court in accordance with the Agreement on the Unified Patent Court of February 19, 2013. The Unified Patent Court is an independent institution established as a consequence of the signing of an international agreement by the Member States of the European Union. However, its establishment and future functioning are closely related to the legal order of the European Union and the fulfilment of the objectives of the Treaties. The article examines the importance of the European Union legal order for the establishment of the unitary system of patent protection in the European Union and, in particular, the Unitary Patent Court.uk-UAArticle
