Оскільки юридична природа спадкового договору залишається дискусійною, досліджено позиції науковців з цього приводу. Визначено деякі особливості спадкового договору та практики його застосування. Обґрунтовано доцільність його використання як ефективного засобу передавання права власності на майно після смерті власників, зокрема щодо майна подружжя. The article is devoted researching of the inherited contract and expediency of its use in the legal relationships of the married couples related to the order of property. Author investigates positions of scientists about legal nature of the inherited contract. Some features of the inherited contract and practice of its application are certain.
