Проаналізовано ключові аспекти законодавчого закріплення процедури фіксації порушень правил дорожнього руху (далі – ПДР), співвідношення елементів процедури із ключовими нормами Конституції України, засадничим принципам Кодексу України про адміністративні правопорушення (далі – КУпАП). Наголошено на наявності певних недоліків у процедурі притягнення особи до адміністративної відповідальності за порушення ПДР, які, очевидно, призведуть до активного оскарження відповідних постанов. The article under studies deals with the investigation of a newly introduced procedure of applying and implementing the system of recording administrative offenses in the field of road safety in automatic mode. It analyzes the key aspects of legislative consolidation of the procedure of fixing traffic violations, the correlation of the procedure elements with the basic provisions of the Constitution of Ukraine, as well as the main principles of the Code of Ukraine on Administrative Offenses. Particular emphasis has been laid on certain shortcomings in the procedure of bringing a person to administrative liability for traffic violations, which will obviously lead to numerous appeals against the corresponding decisions. Consequently, the article contains assessment of the newly introduced norms of the Code of Ukraine on Administrative Offenses in comparison with the provisions of the Constitution of Ukraine, decisions of the Constitutional Court of Ukraine, and certain decisions of the European Court of Human Rights.
