На підставі аналізу історіографії дослідження засад державного контролю, розгляду законодавчих дефініцій «контроль» і «державний контроль», співвідношення контролю з іншими правовими категоріями та поняттями серед властивостей державного контролю автором окреслено такі: державний контроль є складником соціального контролю й державної діяльності, виявом його функції; характеризується спеціальним суб’єктом здійснення – спеціально уповноважені державні органи (посадові особи); має постійну основу та державно-владну природу; передбачає оперативне втручання уповноважених державних органів у діяльність об’єктів і можливість застосування заходів примусу в разі виявлення порушень законодавства. Визначивши сутність і призначення державного контролю, проаналізувавши його властивості, автор сформулював дефініцію «державний контроль у сфері вищої освіти». The article is devoted to the definition of the essence of the legal category “state control in the sphere of higher education”. Based on the analysis of the historiography of the study of the foundations of state control, the examination of legislative definitions of “control” and “state control”, the correlation of control with other legal categories and concepts, the author outlines the following among the properties of state control: state control is a composite social control and an integral part of state activity, The manifestation of its function; is characterized by a special subject of implementation – specially authorized state bodies (officials); has a permanent basis and state-imperious nature; provides for prompt intervention of authorized state bodies in the activities of facilities and the possibility of using coercive measures in case of violations of legislation.
