| dc.description.abstract | У даній статті досліджується використання правових звичаїв у процесі тлумачення. Автор зазначає, що на даний час більшість дослідників схиляються до множинного підходу в розумінні об’єкта юридичної інтерпретації. Це пов’язано зі зростаючою роллю таких правових регуляторів як, наприклад, нормативні й індивідуальні правові договори, прецеденти, правозастосовні і інтерпретаційні акти та правові звичаї. Отже, правовий звичай розглянуто в розрізі теорії тлумачення – як об’єкт тлумачення, а також його застосування під час тлумачення інших нормативних і індивідуальних правових актів. This paper is devoted to study of the legal customs usage in the interpretation process. The author notes that these days the majority of researchers support the idea of multiple approach to understanding the object of legal interpretation. It is connected with the growing role of such regulators as, for example, acts of the Constitutional Court, normative and individual legal treaties, precedents, enforcement and interpretative acts and legal customs. Therefore, the legal custom is studied in the context of the theory of interpretation: as an object of interpretation and its usage in the interpretation of other normative and individual legal acts. | |
