Abstract
В статті розкритий адміністративно-правовий статус Національної поліції України в системі забезпечення організації та діяльності Міністерства внутрішніх справ України. Сформовано, що адміністративно-правового статусу Національної поліції країни складається з: 1) загального, що визначає місце і роль Національної поліції в системі органів виконавчої влади, правоохоронних органах та суспільстві в цілому; 2) цільового, що визначається місією поліції щодо служби суспільству шляхом забезпечення охорони прав і свобод людини, протидії злочинності, підтримання публічної безпеки і порядку; 3) організаційного, що віддзеркалює порядок виникнення (зміни, та припинення) правового статусу, структуру Національної поліції, яка складається з таких галузевих підрозділів та має комплексні структурні підрозділи на місцях; 4) структурного, до складу якого входить системи завдань, функцій, повноважень (адміністративних та інших обов’язків і прав); 5) публічно-запобіжного, який складається з етичних правил поведінки, а також ступенем відповідальності підрозділів і працівників Національної поліції, у випадку не належного виконання своїх обов’язків чи зловживання владою; 6) спеціального (надзвичайний) що встановлює особливості етичної поведінки та повноважень при уведенні в Україні в режимі надзвичайних станів, наприклад, правового режиму воєнного стану. The article reveals the administrative and legal status of the National Police of Ukraine in the system of ensuring the organization and activities of the Ministry of Internal Affairs of Ukraine. It was established that the administrative and legal status of the National Police of the country consists of: 1) general, which determines the place and role of the National Police in the system of executive authorities, law enforcement agencies and society as a whole; 2) the target, determined by the police mission regarding service to society by ensuring the protection of human rights and freedoms, countering crime, maintaining public safety and order; 3) organizational, which reflects the order of emergence (changes and termination) of legal status, the structure of the National Police, which consists of the following branch divisions and has complex structural divisions on the ground; 4) structural, which includes a system of tasks, functions, powers (administrative and other duties and rights); 5) public preventive, which consists of ethical rules of conduct, as well as the degree of responsibility of units and employees of the National Police, in case of improper performance of their duties or abuse of power; 6) special (emergency) that establishes the specifics of ethical behavior and powers when introducing a state of emergency in Ukraine, for example, a legal regime of martial law.
