Abstract
Питання виникнення земельних прав є багатоаспектним і багатогранним. В умовах сьогодення воно набуває теоретичного і практичного значення для їх реалізації. Насамперед це стосується набуття права власності на земельну ділянку. Земельне законодавство не містить чіткого розмежування підстав та умов набуття земельних ділянок у власність громадян, що призводить до термінологічної плутанини та неузгодженості між такими поняттями, як «підстави» та «умови» виникнення права власності на землю. Кожна з цих категорій має самостійне значення в аспекті набуття прав на землю. Виникнення права власності на землю потребує визначення в законі умов, за яких передбачені в Конституції України суб’єкти можуть стати власниками земельних ділянок. Досліджено правову природу підстав та умов виникнення права власності на земельну ділянку в громадян України. Особливу увагу приділено аналізу юридичного факту та структури підстав виникнення права власності на земельні ділянки у громадян України. The issue of land rights is multifaceted and multifaceted. In today’s conditions, it acquires theoretical weight and practical significance for their implementation. First of all, it concerns the acquisition of land ownership. Land legislation does not contain a clear delineation of the grounds and conditions for the acquisition of land owned by citizens, which leads to terminological confusion and inconsistency between concepts such as “grounds” and “conditions” for the emergence of land ownership. Each of these categories has its own significance in terms of acquiring land rights. The emergence of land ownership requires the definition in the law of the conditions under which the subjects provided for in the Constitution of Ukraine may become owners of land. The legal nature of the grounds and conditions of ownership of land for citizens of Ukraine has been studied. Particular attention is paid to the analysis of the legal fact and the structure of the grounds for the emergence of land ownership among the citizens of Ukraine.
