dc.description.abstractУ статті проаналізовано склади злочинів, передбачених ст. 130, 131, 140 Кримінального кодексу України. Авторкою доведено, що у складах злочинів, передбачених ст. 131 та 140 Кримінального кодексу України, збігаються усі ознаки об'єкта, суб'єкта та суб'єктивної сторони, а також обстановка вчинення злочину. Аргументовано, що ознаки діяння складу злочину, передбаченого ст. 140 Кримінального кодексу України, є ширшими, ніж у складу злочину, передбаченого ст. 131 Кримінального кодексу України, тому норми, передбачені ст. 131 і 140 Кримінального кодексу України, будуть перебувати у конкуренції загальної і спеціальної норми.The article analyzes the elements of the crimes provided under Art. 130, 131, 140 of the Criminal Code of Ukraine. The author proves convergence all sings of object, subject and subjective side, and also crime scene in the elements of the crimes provided under Art. 131 and 140 of the Criminal Code of Ukraine. It is argued that the signs of an act of the elements of the crime provided under Art. 140 of the Criminal code of Ukraine are wider, than the elements of the crime provided by Art. 131 of the Criminal code of Ukraine, therefore the norms provided by Art. 131 and 140 of the Criminal code of Ukraine, will be in competition of the general and special norms.uk_UA
