Abstract
Стаття присвячена з’ясуванню суті засобів кримінального процесуального доказування крізь призму інструментальної теорії права. Цей методологічний напрям наукових розвідок права розглядає правові засоби під кутом зору їх функціонального призначення. У теорії права наявний плюралізм думок з приводу тлумачення категорії «правові засоби», що свідчить не лише про багатоаспектність, а й про незавершеність її загальнотеоретичного дослідження. The article is devoted to elucidating the essence of the means of criminal procedural evidence through the prism of the instrumental theory of law. This methodological direction of legal research examines legal means from the point of view of their functional purpose. In the theory of law, there is a plurality of opinions regarding the interpretation of the category "legal means", which indicates not only multifacetedness, but also the incompleteness of its general theoretical research.
