| dc.description.abstract | Досліджуються позиції вчених, а також положення чинного законодавства України в частині визначення змісту поняття «корупція» та виявлення його ознак. Визначено спільні та відмінні ознаки теоретичних підходів учених щодо визначення поняття. Наголошено на розбіжностях щодо законодавчого закріплення поняття «корупція» та його визначенні у теорії адміністративного права. Проаналізовано доктринальні підходи науковців щодо розуміння змісту поняття «корупція», а також особливостей пізнання явища як правової, соціальної, економічної та моральної категорії, що завдає шкоди нормальному функціонуванню етичних і правових відносин у суспільстві та державі. Scientists positions, as well as the provisions of the current legislation of Ukraine concerning the definition of the content of the “corruption” concept and the identification of signs of the phenomenon are researched. Common and distinctive features of the scientists theoretical approaches to definition of the concept are defined. Emphasis is made on the relevant differences regarding the legislative consolidation of the concept of “corruption” and its counterparts in the law theorists scientific works. Doctrinal approaches of scientists to understanding the content of the “corruption” concept, as well as the peculiarities of cognition of phenomenon as a legal, social, economic and moral category, which damages normal functioning of ethical and legal relations in society and the state are analyzed. | |
