Abstract
Стаття присвячена процесу імплементації нормативно-правових актів Європейського Союзу у національне законодавство України. Євроінтеграційні процеси України призво-дять до змін національного законодавства у відповідність до європейських стандартів. Адже членство у Європейському Союзі (далі - ЄС) не можливе без імплементації приписів європейського права. Дана вимога закріплена Європейською Радою у Копенгагенских і Мадридских критеріях, щодо членства у ЄС. При цьому слід відміти що правопорядок кожної держави- члена ЄС є по своєму унікальним та супроводжується індивідуальним підходом в процесі імплементації норм ЄС. Країни не повинні порушувати власні принци-пи розвитку та конституційного ладу імплементуючи міжнародні норми у національне за-конодавство, разом з тим, членство в ЄС вимагає щоб національне законодавство відпо-відало європейському праву. За таких умов постає необхідність вивчення і наукового роз-тлумачення імплементації, встановлення її сутності та складових елементів. Процес ім-плементації повинен бути законодавчо врегульований від цього залежить якість норма-тивно-правових актів. Не менш важливим є питання щодо розмежування понять «імпле-ментація», «адаптація», «гармонізація» які вживаються у наукових дослідженнях та нор-мативно-правових актах як синоніми. У статті розглядається поняття та способи імпле-ментації міжнародної норми у національне законодавство. Наголошується на проблемах які виникають при здійсненні цього процесу. Проаналізовано національне законодавство України яке утворилося на основі співпраці з ЄС. Зроблено акцент на важливість імпле-ментації при виконанні міжнародних зобов’язань державою. Розмежовано поняття «ім-плементація», «адаптація» та «гармонізація» на основі попередніх наукових досліджень, та зроблено власний висновок. Дані поняття є різними у своїй сутності і їх не слід ототож-нювати. Проаналізовані способи імплементації на основі досліджень науковців та акцен-товано увагу на ефективність їх застосування. Запропоновані шляхи вдосконалено проце-су імплементації в Україні. The article is devoted to the process of implementation of norma-tive legal acts of the European Union into the national legislation of Ukraine. The European integration processes of Ukraine lead to changes in national legislation in accordance with Eu-ropean standards. After all, membership in the European Union (hereinafter - the EU) is not possible without the implementation of the prescriptions of European law. This requirement is enshrined by the European Council in the Copenhagen and Madrid criteria for EU membership. At the same time, it should be noted that the legal order of each EU member state is unique in its own way and is accompanied by an individual approach in the process of implementing EU norms. Countries should not violate their own principles of development and constitutional or-der by implementing international norms into national legislation, at the same time, membership in the EU requires that national legislation conform to European law. Under such conditions, there is a need to study and scientifically interpret the implementation, establish its essence and constituent elements. The implementation process must be regulated by law, the quality of regulatory acts depends on it. These concepts are essentially different and should not be equa-ted. Equally important is the question of distinguishing between the terms "implementation", "adaptation", "harmonization", which are used as synonyms in scientific research and legal acts. The article examines the concept and methods of implementing an international norm into national legislation. Emphasis is placed on the problems that arise during the implementation of this process. The national legislation of Ukraine, which was formed on the basis of cooperation with the EU, was analyzed. Emphasis is placed on the importance of implementation in the ful-fillment of international obligations by the state. The concepts of "implementation", "adaptation" and "harmonization" are distinguished on the basis of previous scientific studies, and a perso-nal conclusion is drawn. The proposed ways of improving the implementation process in Ukrai-ne.
