| dc.description.abstract | Стаття присвячена дослідженню правового режиму спадкування в міжнародному приватному праві. Звертається увага на те, що правовий режим пов’язаний із визначенням права, яке буде застосовуватися до спадкування з іноземним елементом. На підставі аналізу законодавства іноземних держав зроблено висновок, що питання, пов’язані із визначенням статуту спадкування вирішується, виходячи або з принципів єдності спадкового майна, або в спосіб його розмежування на рухоме і нерухоме майно. Звертається увага, що статут спадкування має за мету вирішення на основі застосовного права як загальних питань спадкування, так і спеціальних правил щодо спадкування певних прав та обов’язків. The article is devoted to the analysis of legal regime of inheritance in private international law. It is noted that the legal regime is related to the definition of the law that will be applied to the inheritance with a foreign element. Based on the analysis of the legislation of foreign states, it is concluded that the issues related to the determination of the statute of inheritance are resolved based on the principle of 'unity of inheritance’, or in the way of its delineation into movable and immovable property. It is outlined that the statute of inheritance is intended to decide on the basis of applicable law, both – general issues of inheritance and special rules for the inheritance of certain rights and duties. | |
