| dc.description.abstract | Окреслено загальні напрями перевірки платоспроможності особи, яка може бути причетна до незаконного збагачення. Визначено, що така перевірка має охоплювати аналіз (порівняння) за певний період часу двох основних складових: а) отримані активи (доходи) зазначеної особи та членів її сім’ї; б) видатки і стиль життя. Під час визначення дохідної та видаткової частин необхідно ґрунтуватися на декларації особи, яка може бути причетна до незаконного збагачення, а також членів її сім’ї. Також слід ураховувати в процесі підрахунку дохідної частини коштів кожного повнолітнього працездатного члена сім’ї, який зазначений у декларації, сум коштів, що не підлягають декларуванню (50 прожиткових мінімумів, встановлених для працездатних осіб на 1 січня звітного року). Запропоновано одним зі способів використання як доказів у кримінальному провадженні про незаконне збагачення встановлення витрати побутового рівня – ураховувати суму мінімального прожиткового мінімуму, згідно зі щорічним чинним законодавством України, на одну особу. Для цього спочатку слід встановити різницю між загальною сумою отриманих активів (доходів) особи, яка може бути причетна до незаконного збагачення, та членів її сім’ї із загальною сумою витрат на побутовому рівні, а потім отриману суму порівняти з активами, які є предметом незаконного збагачення. Зазначене надасть додаткові докази щодо протиправного стилю життя особи та членів її сім’ї, а також можливостей отримувати протиправні активи.In article determinates general ways of person’s solvency audition, that may be participated in illegal enrichment. Determined, that such audition have to consist of analysis (comparing) for a certain period of time two main parts: а) received actives (incomes) that person and its relatives; b) expenditures and lifestyle. Herewith during determination of incomes and expenditures it is necessary to use declaration of person, that can be involved in illegal enrichment crimes, and its relatives. Emphasizes the need to take into account funds which are not an object of declaration (50 subsistence minimum established for able-bodied persons on January 1 of the reporting year) during process of calculating income part of funds of any adult able-bodied member of the family mentioned in declaration. Was proposed, as one of the ways of using as evidence in criminal proceedings about illegal enrichment, determination of household living expenses – determine amount of the minimum subsistence minimum established by the annual Ukrainian legislation in force per one person. It is considered necessary at first establish the difference between the total amount of the received assets (revenues) of the person that can be involved in illegal enrichment and his relatives with general amount of household living expenses. Secondary, gained sum compare with actives which are the object of illegal enrichment. The specified will provide additional evidences about illegal lifestyle of person and its family and about possibility in receiving illegal actives. | uk_UA |
