Abstract
У статті розкрито ознаки стандарту доказування «поза розумним сумнівом» і запропоновано авторське визначення його поняття. Встановлено співвідношення досліджуваного стандарту зі встановленням об’єктивної істини і внутрішнім переконанням суб’єктів доказування. Досліджено правові позиції Верховного Суду щодо визначення поняття та змісту стандарту доказування «поза розумним сумнівом». Обґрунтовано доцільність внесенн я доповнень до чинного КПК України, спрямованих на розширення змісту вказаного стандарту. In the article the signs of the standard of proof «beyond reasonable doubt» are disclosed and the author’s definition of its concept is proposed. The correlation of the investigated standard with the establishment of objective truth and the internal conviction of the subjects of proof is established. The legal positions of the Supreme Court concerning the definition and content of the standard of proof “beyond reasonable doubt” are investigated. The expediency of introducing additions to the current CPC of Ukraine, aimed to extending of the content of the specified standard, is substantiated.
