Abstract
Стаття присвячена дослідженню вимог до форми і змісту ухвал слідчого судді про накладення грошового стягнення та відмову в задоволенні клопотання слідчого, прокурора про накладення грошового стягнення. Із урахуванням норм кримінального процесуального закону й теоретичних положень досліджуються вимоги законності, обґрунтованості та вмотивованості в частині їх застосування до вказаних ухвал. Визначаються вимоги до змісту вступної, мотивувальної й резолютивної частин цих ухвал слідчого судді. The article is dedicated to the consideration of requirements to form and content of decisions of the investigating judge about imposition of monetary penalty and about refusal to petition for the imposition of monetary penalty. Based on the results of the analysis of the rules of criminal procedural law and theoretical positions the requirements of legality, validity and motivation in the part of their application to these decisions investigated.
The requirements to the content of introduction, motivation and resolution parts of these decisions of investigating judge defined.
