| dc.description.abstract | Статтю присвячено теоретичним та практичним аспектам застосування норм цивільного права до регулювання сімейних відносин в Україні. Розглянуто позиції учених різних юридичних шкіл нашої держави на прикладне значення застосування норм цивільного законодавства до регулювання сімейних відносин. Підтримано доктринальний підхід, за яким норми цивільного права до регулювання сімейних відносин застосовуються не безпосередньо, а субсидіарно. Доведено, що в ч. 1 ст. 8 СК України законодавцеві якнайкраще не перелічувати коло учасників відповідних відносин, а також не диференціювати види відносин, що належать до предмета сімейно-правового регулювання, бо це не відповідає меті аналізованої норми сімейного права. The article is devoted to theoretical and practical aspects of application of Civil Law rules to regulation of family relations in Ukraine. The positions of scientists of different law schools of our country on the applied importance of applying the rules of Civil Law to the regulation of family relations are considered. A doctrinal approach is supported, by whom the rules of Civil Law are applied not directly but indirectly to the regulation of family relations. It is proved that in Part 1 of Article 8 of the Family Code of Ukraine to the legislator is best not to list the number of participants in the relevant relations, nor to differentiate the types of relations that are subject to Family Law, because this is not consistent with the purpose of the analyzed rule of Family Law. | |
