Abstract
Досліджуються права людини як пріоритет національної безпеки України, аналізуються порушення та обмеження прав людини як фактор, що загрожує національній безпеці, визначаються допустимі обмеження прав людини. Увага акцентується на такому аспекті забезпечення безпеки людини, як захист від раптових та небезпечних потрясінь, що руйнують звичний спосіб життя. Обґрунтовано висновок, що у випадку терористичної загрози можливі обмеження прав людини, однак основний принцип протидії тероризму має бути непорушним. Це відповідність засобів і методів протидії рівню терористичної загрози. Human rights are studied as a priority of Ukraine’s national security, violations and limitations of human rights are analyzed as a factor threatening national security, permissible limitations of human rights are determined. Rights and freedoms can be threatened by various factors, such as the war waged by Russia against Ukraine, corruption, injustice, a deep stratifi cation of society into rich and poor, criminalization of social relations, imperfection and obsolescence of the legislative framework, deformation of the legal awareness of the population, reduction of the moral potential of society. Attention is focused on such an aspect of ensuring human safety as protection against sudden and dangerous shocks that destroy the usual way of life. A signifi cant role in ensuring human safety belongs to criminal law regulation, implementation of the protective function of criminal law. When high-ranking persons are brought to criminal responsibility, constitutional norms are signifi cantly violated, but only to the benefi t of the off enders themselves.
