Abstract
У статті проаналізовано законодавство України, що закріплює правові норми про штрафні господарсько-правові санкції, їх види (штраф, пеня), порядок, підстави й особливості їх застосування в договірних та позадоговірних зобов’язаннях. Звернуто увагу на розбіжності у визначенні понять у різних джерелах права, зокрема в Господарському та Цивільному кодексах. Наведено способи нарахування штрафних санкцій та порядок їх стягнення. The article analyzes the legislation of Ukraine, which establishes the legal norms on economic penalties, their types (fine, penalty), procedure, grounds and features of their application in contractual and non-contractual obligations. Attention is drawn to the differences in the definition of concepts in different sources of law, including economic and civil codes. The methods of accrual of penalties and the procedure for their collection are given.
