Abstract
Статтю присвячено висвітленню теоретико-правових та практичних питань відступу від правового висновку Верховного Суду на підставі зміни підходів до праворозуміння. Автором обґрунтовано, що після внесення змін до Конституції України щодо правосуддя мала місце зміна основоположної конституційної засади правосуддя з верховенства закону на верховенство права, що стало однією з основних причин зміни підходів до праворозуміння у вітчизняній судовій практиці. The article is devoted to the coverage of theoretical-legal and practical issues of deviation from the legal opinion of the Supreme Court on the basis of changing approaches to legal understanding. The author substantiated that after the amendments to the Constitution of Ukraine regarding justice there was a change in the fundamental constitutional principle of justice from the supremacy of the law to the supremacy of law, which became one of the main reasons for the change in approaches to legal understanding in domestic judicial practice.
